PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES January 17, 2012 A meeting of the Pennington County Board of Commissioners was held on Tuesday, January 17, 2012, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Lyndell Petersen called the meeting to order at 9:00 a.m. with the following Commissioners present: Ron Buskerud, Ken Davis, Don Holloway and Nancy Trautman. REVIEW AND APPROVE AGENDA MOVED by Trautman and seconded by Holloway to remove Items 12a, Pennington County Courthouse Campus Expansion Project, and 12b, Block 99 – Administration & Evidence Buildings and Site Work, and approve the agenda as amended. Vote: Unanimous. Consent Agenda Items The following items have been placed on the Consent Agenda for action to be taken by a single vote of the Board of Commissioners. Any item may be removed from the Consent Agenda for separate consideration. MOVED by Trautman and seconded by Holloway to approve Consent Agenda Items 5-7. Vote: Unanimous. 5. Approval of the minutes of the Board of Commissioners’ meeting held on January 3, 2012. 6. Approval of the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment totaling $1,428,432.44 and authorization for the Chairperson’s signature. 7. Approval of the 1st Quarter State and Local Agreement (SLA) Report from Emergency Management and authorization for the Chairperson’s signature. End of Consent Agenda. EM-BRF 6403(06), PCN 00CL, RECONSTRUCT SOUTH ROCHFORD ROAD FROM ROCHFORD TO DEERFIELD ROAD – Mr. Joel Jundt: MOVED by Trautman and seconded by Davis to proceed with the Environmental Impact Study contract for the South Rochford Road reconstruction project. Vote: Unanimous. REQUEST TO FORM AN AMBULANCE DISTRICT IN WALL BY MEANS OF RESOLUTION: Representatives from the Wall City Council and ambulance service were present to discuss the formation of an ambulance district for Eastern Pennington County by resolution of the Board of Commissioners as set forth in SDCL34-11A-1. Chairperson Petersen asked the representatives to notify Commission Office Manager Holli Hennies regarding the details of the information meetings as they are scheduled. ITEMS FROM AUDITOR A. Budget Supplement Hearing SP12-002 – General Fund Sheriff Budget (Cops Grant Revenue): MOVED by Trautman and seconded by Holloway to approve the supplement to the 2012 General Fund Sheriff budget in the amount of $60,575 from non-budgeted grant revenue. First Reading And Public Hearing Of Ordinance Amendment – Pennington County Ordinance No. 142 – An Ordinance Establishing Fees And Requirements For Issuance Of Certain Alcoholic Beverage Licenses: MOVED by Buskerud and seconded by Davis to approve the first reading of Ordinance No. 142. Vote: Unanimous. B. First Reading And Public Hearing of Pennington County Ordinance No. 631 – Special Alcoholic Beverage Licenses Within Pennington County: MOVED by Buskerud and seconded by Trautman to continue this item to the February 7, 2012, Board of Commissioner’s meeting. Request Approval of Local Emergency Operations Plan: MOVED by Trautman and seconded by Davis to authorize the Chairperson’s signature on the Approval and Implementation Resolution - Emergency Operations Plan as presented. Vote: Unanimous. APPROVAL AND IMPLEMENTATION RESOLUTION EMERGENCY OPERATIONS PLAN WHEREAS the County Commission of Pennington County, South Dakota, recognizes the need to prepare for, respond to, and recover from natural and manmade disasters; and WHEREAS Pennington County has a responsibility to provide for the safety and wellbeing of its citizens and visitors; and WHEREAS Pennington County has established and appointed a Director and Coordinator of Emergency Management. SDDOT Site Use Agreement: MOVED by Davis and seconded by Trautman to enter into an Agreement with the South Dakota Department of Transportation (SDDOT) for the purchase of salt and sand stockpile materials and authorize the Chairperson’s signature on the Agreement. Vote: Unanimous. Hazardous Situation – Old State Highway 1416 On The Dump Ground Road MOVED by Davis and seconded by Trautman to continue this item to the February 7, 2012, County Board meeting to determine the size of the culvert. Substitute Motion: MOVED by Holloway and seconded by Buskerud to direct the Highway Superintendent to contact Fairview and Lake Hill Township Boards and work out the responsibility for repairs to the section line road. The motion carried 4-1 with Davis opposing. Proposed Pennington County Compensation Committee MOVED by Buskerud and seconded by Holloway to proceed with formation of the Pennington County Compensation Committee. Vote: Unanimous. Request for Support of Proposed Legislation for Habeas Corpus – Post-Conviction Relief Limitations: MOVED by Davis and seconded by Trautman to authorize the Chairperson’s signature on a letter to Pennington County’s legislators and the Senate Judiciary Committee expressing Pennington County’s support for Attorney General Marty Jackley’s proposed legislation regarding post-conviction relief limitations, and further moved to authorize the Chairperson’s signature on letters encouraging other Black Hills counties to support the proposed legislation. Vote: Unanimous. REQUEST TO WAIVE PENALTY FEE – Mr. Michael Leiby MOVED by Holloway and seconded by Davis to deny Michael Leiby’s request to waive Planning & Zoning Ordinance penalty fees totaling $302.00. Vote: Unanimous. REQUEST TO AMEND COST SHARE AGREEMENT FOR SPRING CREEK WATERSHED 319 PROJECT – Ms. Gail Mayer 2010SPC13 MOVED by Holloway and seconded by Trautman to modify Gail Mayer’s cost share contract (2010SPC13) to allow $7.67 per linear foot for the excavation of the water line based on contractor bids. It was noted that the “not to exceed” total will not change for the contract. Vote: Unanimous. Commissioner Buskerud left the meeting at 11:25 a.m. ZONING ORDINANCE AMENDMENT FEES Deputy State’s Attorney Patrick Grode will present two resolutions for the Board of Commissioners to consider at the February 7, 2012, meeting.
