PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES August 17, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, August 17, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairman Ethan Schmidt called the meeting to order at 9:03 a.m. with the following Commissioners present: De Glassgow, Gale Holbrook, Nancy Trautman and Brenda Young. REVIEW AND APPROVE AGENDA MOVED by Young and seconded by Trautman to approve the agenda as presented. Vote: Unanimous. REVIEW MINUTES MOVED by Trautman and seconded by Young to approve the minutes of the August 3, 2010, Board of Commissioners' meeting. Vote: Unanimous. ITEMS FROM AUDITOR A. TOWNSHIP BONDS: MOVED by Trautman and seconded by Young to set the bond for any organized civil township located in Pennington County at the minimum amount received by that township in the last calendar year and set the township clerk bond amount at $5,000. It was further moved to authorize the Auditor to hold monies due to a township until annual reports and clerk and treasurer bond information is received by April first of each year. Vote: Unanimous. MOUNTAIN PINE BEETLE PRESENTATON – BOB THOMPSON MOVED by Trautman and seconded by Glassgow to draft a letter from the Pennington County Board of Commissioners for Commissioner Glassgow to present to the Deputy Undersecretary of the USDA supporting aggressive measures to combat the mountain pine beetle epidemic in the Black Hills National Forest, and further moved to authorize the Chairman’s signature thereto. Vote: Unanimous. ITEMS FROM EMERGENCY MANAGEMENT A. 2010 HOMELAND SECURITY CONDITIONAL GRANT AWARD #2: MOVED by Glassgow and seconded by Holbrook to approve Homeland Security Conditional Grant Award #2 for the 2011 Homeland Security Conference in the amount of $150,000 and authorize the Chairman’s signature thereto. PROPOSED PENNINGTON COUNTY COMMISSION TRAVEL POLICY – Commissioner Holbrook: MOVED by Holbrook and seconded by Glassgow to approve the proposed Commission Office Travel Policy as follows: It is the policy of the Office of the County Commissioners that any travel outside of Pennington County by any County Commissioner must first be authorized by a majority vote of the County Commissioners. Vote: Unanimous. NATIONAL FOREST COUNTIES AND SCHOOL COALITION MOVED by Trautman and seconded by Young that Pennington County join the National Forest Counties and School Coalition with 2010 membership dues in the amount of $578.63. Vote: Unanimous. 2011 PROVISIONAL BUDGET UPDATES Per SDCL 7-21-8, the Board of Commissioners will meet on Tuesday, September 7, 2010, for the purpose of considering the 2011 budget. WESTERN STATE VETERAN’S HOME – CONGRESSIONAL LETTERS OF SUPPORT: MOVED by Holbrook and seconded by Glassgow to authorize all Pennington County Commissioners’ signatures on the proposed letter to General Steven R. Doohen in support of locating a new Western State Veteran’s Home in Rapid City. Vote: Unanimous. MISCELLANEOUS A. APPROVE VOUCHERS: MOVED by Trautman and seconded by Holbrook to approve the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment, and authorize the chair’s signature thereto. To reduce the minimum required rear yard setback (south property line) from 25 feet to 12 feet in a Limited Agriculture/ General Agriculture District in accordance with Sections 206 and 509 of the Pennington County Zoning Ordinance. Moved by Holbrook and seconded by Glassgow to approve Setback Variance 10-16 with (4) conditions recommended by Planning staff. Vote: Unanimous. 1. That a Building Permit be obtained for the subject barn, in which administrative fees will be assessed; 2. That prior to issuance of a Building Permit for the subject barn, an approved Floodplain Development permit be obtained demonstrating the barn’s compliance with Pennington County’s Flood Damage Prevention Ordinance; 3. That prior to issuance of a Building Permit for the subject barn, an approved On-Site Wastewater Construction Permit be obtained if the barn contains plumbing and is tied into an on-site wastewater treatment system; and, 4. That approval of this Variance request only applies for the portion of the rear-yard (south property line) setback that is encroached upon by the existing barn. All other structures must maintain proper setbacks or obtain separate Variance(s) for that structure. B. VARIANCE / VA 10-17: Adrian and Cheryl Goodhue. To reduce the minimum required lot size from 10 acres to 1.75 acres and 1.48 acres in a Limited Agriculture District in accordance with Sections 206 and 509 of the Pennington County Zoning Ordinance. MOVED by Holbrook and seconded by Young to sustain Planning staff’s recommendation to approve Subdivision Regulations Variance 10-08 to waive the submittal of engineered road construction plans and road improvements and approve Minor Plat 10-30 with the following two (2) conditions. Vote: Unanimous. 1. That all structures and the existing on-site wastewater disposal system meet all the required setbacks from the proposed future lot lines; and, 2. That prior to County Board approval of the Minor Plat, the two lots either be rezoned to Suburban Residential District or Lot Size Variances be obtained to allow the 1.752 acre and 1.481 acre lots. MINOR PLAT / PL 10-26 AND SUBDIVISION REGULATIONS VARIANCE / SV 10- 07: Cheryl and Todd Bachman; Sanders Family Trust. To reconfigure lot lines to create Tract Adonis and Tract Sunshine and to waive the requirement for submittal of percolation tests and soil profile information in accordance with Sections 400.3 and 700.1 of the Pennington County Subdivision Regulations. Vote: Unanimous. 1. That the applicants post the road sign for Sanders Ranch Road prior to the recording of the Minor Plat; 2. That prior to County Board approval of the Minor Plat, the applicant provides soil profile and percolation tests information for proposed Tract Sunshine; 3. That prior to submittal of the mylar, the access easement which traverses through Gov’t 2 and Gov’t 4 be labeled as a 66-foot-wide access easement; 4. That Black Hills Electric Cooperative’s rights to operate and maintain the overhead line are not diminished or adversely affected in any way by the proposed subdivision; 5. That the only types of systems to be allowed on this lot will either need to be a mound system, which meets the 4-foot soil separation from the restrictive layer, or an evapotranspiration system. An evapotranspiration system will require site grading due to the slopes existing on this lot; 6. That due to the bedrock and the possibility of negative environmental impacts, an advanced pretreatment-type septic tank is required with a signed Service Agreement for Tract Sunshine Lode No. 8 M.S. 1608; and, 7. That any alternative type of On-Site Wastewater Treatment Systems must be designed and certified by a Registered Professional Engineer or Licensed Plumber.
