PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES July 20, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, July 20, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Ethan Schmidt called the meeting to order at 9:00 a.m. with the following Commissioners present: De Glassgow, Gale Holbrook, Nancy Trautman and Brenda Young. ORDER FOR ORGANIZATION AND INCORPORATION OF THE WHALEY LANE ROAD DISTRICT PENNINGTON COUNTY, SOUTH DAKOTA WHEREAS, all resident registered voters and property owners that are within the proposed district boundaries have agreed to and petitioned for the organization of the Whaley Lane Road District. AND WHEREAS, said petitions indicate the desire of all qualified voters and landowners within the proposed boundaries to organize the Whaley Lane Road District NOW, THEREFORE, BE IT ORDERED, that the Pennington County Commission acknowledge and declare the Whaley Lane Road District to be organized and established as a governmental subdivision of the State of South Dakota and a public body, corporate and political to be effective as of today’s date with taxing authority for the 2010 pay 2011 tax year and after. PROJECT FUNDING AND RECOMMENDATIONS: MOVED by Holbrook and seconded by Trautman to authorize the Master Planning Committee to work with Local Counsel, the Underwriter and Bond Counsel to develop a potential funding/project package based on the recommendations outlined in the Facilities Master Plan previously adopted by the Board of Commissioners. AUTHORIZATION TO BID – SURPLUS EQUIPMENT: MOVED by Young and seconded by Trautman to authorize the highway superintendent to place bids on the IronPlanet internet auction to be held on July 29, 2010, for a 1997 Ford CF7000 with a Rosco RA-300 Pothole Patcher and a 2006 Sterling SC8000 with a Tiger Pothole Patcher, with bids not to exceed 80 percent of the quote received from Titan Machinery of Rapid City, SD, and further moved to authorize payment by wire transfer to IronPlanet if Pennington County is the successful bidder. REQUEST TO AMEND JULY 6, 2010, MOTION: MOVED by Trautman and seconded by Young to rescind the motion made during the July 6, 2010, Commission meeting that directed the Human Resources (HR) Manager to develop a form to consistently document vacation and sick leave for exempt County employees. Vote: Unanimous. MOVED by Young and seconded by Trautman that County department heads that have a consistent, viable method of tracking sick, vacation and holiday hours for exempt employees should confirm that method with the HR Manager, and if no other method for tracking exempt employees is being used, departments should utilize the simple form developed by the HR Manager for that purpose. PENNINGTON COUNTY EMPLOYEE HANDBOOK POLICY 722 - TAX CERTIFICATE: MOVED by Trautman and seconded by Glassgow to remove Policy #722 titled “Tax Sale Certificate” from the Pennington County Employee Handbook pursuant to the recommendation of Human Resources Manager Nick Stroot and Chief Deputy States’ Attorney Jay Alderman. Vote: Unanimous. REQUEST FOR STREET CLOSURE – Donna Crawford: MOVED by Holbrook and seconded by Trautman continue this item to the August 3, 2010, Board of Commissioners’ meeting. Vote: Unanimous. MISCELLANEOUS A. APPROVE VOUCHERS: MOVED by Holbrook and seconded by Trautman to approve the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment, and authorize the chair’s signature thereto. REQUEST FOR REFUND OF ADMINISTRATIVE FEES – EUGENE PLUTH: MOVED by Trautman and seconded by Holbrook to deny Eugene Pluth’s request to refund building permit fees in the amount of $51.00, pursuant to Planning staff recommendation. VARIANCE / VA 10-14: Kay Martin. To reduce the minimum required front yard setback from 25 feet to 3 feet along Nugget Street and to also reduce the minimum required front yard setback from 25 feet to 7 feet along Edelweiss Mountain Road in a Suburban Residential District in accordance with Sections 208 and 509 of the Pennington County Zoning Ordinance. Lots 15 and 16, Block 8, Silver City, Section 31, T2N, R5E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Trautman to approve Variance / VA 10-14 with three conditions pursuant to Planning staff’s recommendation. Vote: Unanimous. 1. That this Variance only applies for the portion of the setback requirements that are encroached upon by the existing residence and will be encroached upon by construction of the proposed addition. All other structures must maintain the proper setback requirements or obtain separate Variance(s) for that structure; 2. That at the time a Building Permit is applied for, the existing wastewater system (tank and drainfield) for the cabin shall be located to ensure it will meet all required setbacks from the proposed cabin addition. If it is determined that the wastewater system does not meet the minimum setback requirements from the cabin addition, a Variance shall be obtained from DENR prior to the issuance of the Building Permit; and, 3.
