PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES June 15, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, June 15, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Ethan Schmidt called the meeting to order at 9:00 a.m. with the following Commissioners present: De Glassgow, Gale Holbrook, Nancy Trautman and Brenda Young. REVIEW AND APPROVE AGENDA: MOVED by Trautman and seconded by Young to approve the agenda with the following amendment: Move 2011 Provisional Budget to follow Item 9, Items from Buildings & Grounds. Vote: Unanimous. REVIEW MINUTES: MOVED by Holbrook and seconded by Young to approve the minutes of the June 1, 2010, Board of Commissioners' meeting and the June 11, 2010, Special Board of Commissioners’ meeting. SURPLUS PROPERTY – HANDGUNS: MOVED by Holbrook and seconded by Young to declare 12 Glock Model 22 / .40 caliber duty handguns as surplus to use as trades for replacement duty handguns. FACILITY RE-ROOF PROJECT: MOVED by Holbrook and seconded by Young to authorize Buildings & Grounds to advertise for bids for re-roofing projects at the original Courthouse and Annex, the Pennington County Jail and the County storage building at 517 3rd Street. Vote: Unanimous. B. SURPLUS PROPERTY - X MARK MOWER: MOVED by Trautman and seconded by Young to declare surplus one X-Mark mower, Serial Number 440579, for trade on a replacement mower. Vote: Unanimous. 2011 PROVISIONAL BUDGET (Continued from above) B. RAPID CITY ECONOMIC DEVELOPMENT PRESENTATION – BEN SNOW C. 2011 PROVISIONAL BUDGET REVISIONS INCLUDING EMPLOYEE MERITS: MOVED by Glassgow and seconded by Young to reduce the 2011 Senior Citizen Transportation Funding request to $12,156. Vote: Unanimous. MOVED by Trautman and seconded by Holbrook to restore the Behavior Management budget line item to $88,565 for 2011. Vote: Unanimous. MOVED by Trautman and seconded by Glassgow to approve employee merit raises totaling $553,506 in the 2011 budget. Vote: The motion carried 4-1 with Schmidt voting no. MOVED by Holbrook and seconded by Trautman to authorize the addition of one full time equivalent for Planning & Zoning for 2011 in the amount of $46,024 with the salary split between Planning & Zoning and Water Protection. Vote: Unanimous. MOVED by Holbrook and seconded by Trautman to approve the Black Hills Vision Funding Request of $50,000 to be paid at the rate of $10,000 per year for five years. Substitute motion: MOVED by Young and seconded by Glassgow that no action be taken on this item until revised Provisional Budget figures are available, including the today’s changes. Vote: Unanimous. Vote: Unanimous. KEYSTONE PIPELINE INFORMATIONAL UPDATE MISCELLANEOUS A. APPROVE VOUCHERS: MOVED by Holbrook and seconded by Trautman to approve the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment, and authorize the chair’s signature thereto. Vote: Unanimous. Commissioner Trautman stated that she would abstain from voting on the following item and left the meeting during discussion. REQUEST TO RESCIND ACTION – APPEAL OF CONDITIONAL USE PERMIT CU 10-08: MOVED by Glassgow and seconded by Holbrook to continue the Appeal of Conditional Use Permit CU 10-08 to the July 6, 2010, Board of Commissioners’ meeting to allow time for the State’s Attorney to review the information provided by Chris and Jolene Hinckley. Vote: The motion carried with 4 affirmative votes. (Trautman abstained). The Board recessed from 10:40 a.m. and reconvened at 10:48 a.m. with all members present. MOVED by Glassgow and seconded by Trautman to move Item 17C, On-Site Wastewater Treatment Systems Ordinance / OA 10-02, ahead of other Planning & Zoning items. Vote: Unanimous. A. ON-SITE WASTEWATER TREATMENT SYSTEMS ORDINANCE / OA 10-02: MOVED by Young and seconded by Trautman to schedule the first reading of the proposed On- site Wastewater Treatment Systems Ordinance for 9 a.m. on June 22, 2010, in the Commissioners’ Meeting Room of the Pennington County Courthouse. Vote: Unanimous. MOVED by Trautman and seconded by Young to establish the format for the first hearing of the On-Site Wastewater Treatment Systems Ordinance OA 10-02 with the following guidelines: 1. That proposed changes from the Board of Commissioners shall be reviewed at the beginning of the meeting. 2. That public testimony will be one hour and will be closed to public testimony after such time to allow one half hour for the Board of Commissioners to discuss the proposed ordinance and testimony. The Board of Commissioners may clarify or ask questions of the public as required during this half hour. 3. That each testimony is limited to seven minutes per person with each person being allowed to speak once. Those wishing to speak shall sign the sign-in sheet indicating their intention. No person who is testifying may transfer their allotted time to any other person. No personal attacks or disruptive behavior will be allowed and if such should occur, the person responsible for these actions will be asked to leave the hearing. Substitute motion: MOVED by Schmidt to allow three hours of public testimony from 9 a.m. to noon and one hour for the Board of Commissioners to discuss The On-Site Wastewater Treatment Systems Ordinance OA 10-02. The motion died for lack of a second. Glassgow left the meeting at this time. CANYON SPRINGS PRESERVE SURETY UPDATE: MOVED by Holbrook and seconded by Trautman to retain the current letter of credit for Canyon Springs Preserve until the County Fire Administrator and Doty Volunteer Fire Department are satisfied that the water system is adequate for fire suppression.
