PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES May 18, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, May 18, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Ethan Schmidt called the meeting to order at 9:00 a.m. with the following Commissioners present: De Glassgow, Gale Holbrook, Nancy Trautman and Brenda Young. REVIEW AND APPROVE AGENDA: MOVED by Trautman and seconded by Young to approve the agenda with the following amendments: remove Item 8 – Rochford Volunteer Fire Department Raffle Request, and Item 10 – Rapid City Library Board Information Item. Vote: Unanimous. REVIEW MINUTES: MOVED by Trautman and seconded by Holbrook to approve the minutes of the May 4, 2010, Board of Commissioners' meeting. Vote: Unanimous. CENTRAL STATES FAIR – REIMBURSEMENT REQUEST: MOVED by Trautman and seconded by Holbrook to approve the Central States Fair’s reimbursement request for expenditures made for repairs and maintenance through March 31, 2010, totaling $26,118.35. ORDER FOR ORGANIZATION AND INCORPORTATION – SUMMER CREEK DRIVE ROAD DISTRICT: MOVED by Holbrook and seconded by Trautman to acknowledge the Order for Organization and Incorporation for the Summer Creek Drive Road District effective for tax year 2010 and thereafter, and authorize the Chairman’s signature thereon. ORDER FOR ORGANIZATION AND INCORPORATION OF THE SUMMER CREEK DRIVE ROAD DISTRICT PENNINGTON COUNTY, SOUTH DAKOTA WHEREAS, all resident registered voters and property owners that are within the proposed district boundaries have agreed to and petitioned for the organization of the Summer Creek Drive Road District; AND WHEREAS, said petitions indicate the desire of all qualified voters and landowners within the proposed boundaries to organize the Summer Creek Drive Road District; NOW, THEREFORE, BE IT ORDERED, that the Pennington County Commission acknowledge and declare the Summer Creek Drive Road District to be organized and established as a governmental subdivision of the State of South Dakota and a public body, corporate and political to be effective as of today’s date with taxing authority for the 2010 tax year and after. COURTHOUSE ENTRANCE BEAUTIFICATION PROJECT-RICK ABRAHAMSON: MOVED by Trautman to authorize Buildings & Grounds and Extension to proceed with replanting the flower beds by the Courthouse main entrance. The motion died for lack of a second. MOVED by Holbrook and seconded by Glassgow to authorize Buildings and Grounds to implement a revised Option 4, reducing the number of planters and benches to four each, and further moved to limit expenditures to $2000. Vote: The motion failed on a 3-2 vote with Schmidt, Trautman and Young voting no. ITEMS FROM FIRE ADMINISTRATOR: MOVED by Young and seconded by Trautman to approve the Agreement for Mutual Aid in Fire Protection and Hazardous Material Incidents Response with Ellsworth Air Force Base and authorize the Chairman’s signature. ITEMS FROM HIGHWAY A. 2010 NATIONAL MULTIPLE SCLEROSIS SOCIETY WEEKEND RIDE IN THE HILLS: MOVED by Young and seconded by Trautman to approve the Application for Permit to Occupy Right-of-Way as submitted by the National Multiple Sclerosis Society for the Black Hills Weekend Ride in the Hills on August 28 & 29, 2010, and authorize the Pennington County Highway Superintendent to sign the permit. Vote: Unanimous. B. ADOPT- A-HIGHWAY PROGRAM – SHERIDAN LAKE ROAD: MOVED by Young and seconded by Trautman to authorize the Chairman’s signature on the letter authorizing Reder Ranch’s request to adopt a portion of Sheridan Lake Road. Vote: Unanimous. MISCELLANEOUS A. APPROVE VOUCHERS: MOVED by Trautman and seconded by Glassgow to approve the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment, and authorize the chair’s signature thereto. Vote: Unanimous. REQUEST TO WAIVE ADMINISTRATION FEES – JEFF BARBER & BRENDA SHIPPEN: MOVED by Trautman and seconded by Young to deny the waiver of $800 in fees as requested by Jeff Barber & Brenda Shippen. Vote: The motion carried 3-2 with Holbrook and Glassgow voting no. REQUEST TO WAIVE REQUIREMENT – CODY SCHAD: MOVED by Trautman and seconded by Young to deny Cody Schad’s request to waive the requirement to submit engineered road plans for a road to be constructed within a section line right-of-way. Vote: The motion carried 4-1 with Holbrook voting no. ITEMS FROM PLANNING AND ZONING A. APPROVAL OF DENR CONTRACT – 319 SPRING CREEK PROJECT: MOVED by Holbrook and seconded by Young to authorize the Chairman’s signature on the contract with the DENR accepting the 319 Spring Creek Grant funds totaling $324,000. Vote: Unanimous. B. MOTION SUPPLEMENT (SP10-008) - GENERAL FUND 319 DENR GRANT BUDGET: MOVED by Young and seconded by Trautman to approve a supplement to General Fund 319 DENR Grant budget in the amount of $394,050 from non-budgeted revenue collected in the current year. Vote: Unanimous. C. WATER PROTECTION REVENUE SHORTFALL: MOVED by Trautman and seconded by Young to recognize a 2010 non-tax revenue shortfall in the General Fund Water Protection budget and allow spending of the 2010 budget. Vote: Unanimous. D. APPEAL OF CONDITIONAL USE PERMIT / CU 10-08: Chris and Jolene Hinckley. To allow for an Adult Foster Care Home in a Suburban Residential District in accordance with Sections 208 and 510 of the Pennington County Zoning Ordinance. Lot 4, Block 1, Palmer Subdivision Addition, Section 14, T2N, R6E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Young to deny Conditional Use Permit 10-08 and further moved that enforcement will not begin for one year. MOVED by Holbrook to call the question. Vote: 4-1 with Trautman voting no. Roll call vote on the original motion: Holbook – aye, Glassgow – no, Schmidt – no, Trautman – no, Young – aye. The motion failed 3-2. Holbrook left the meeting at noon. MOVED by Trautman and seconded by Glassgow to sustain the Planning Commission recommendation to deny Conditional Use Permit 10-08 and further moved that enforcement will not begin for six months. Vote: The motion carried 3-1 with Young voting no. E. FIRST READING AND PUBLIC HEARING OF REZONE / RZ 09-08 AND COMPREHENSIVE PLAN AMENDMENT / CA 09-06: James Hynes/Aubrey Pope; Frances Aubrey – Agent. To rezone 1.13 acres from General Agriculture District to Highway Service District and to amend the Comprehensive Plan to change the Future Land Use from Plan (PUD Sensitive) to Highway Service District in accordance with Section 508 of the Pennington County Zoning Ordinance. Lot B of Home Sweet Home Placer MS 804 and Lot B of (Lot 7) Tract 37, all located in Section 4, T2S, R5E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Young to approve the First Reading and Public Hearing of Rezone RZ 09-08 and Comprehensive Plan Amendment / CA 09-06 pursuant to Planning Commission recommendation. Vote: Unanimous. F. ROAD NAME: Turkey Hill Trail. Proposed road naming for the 40-foot-wide and 66-foot- wide private access easement which provides access to properties located in Section 31, T2N, R7E, and Section 6, T1N, R7E, all in BHM, Pennington County, South Dakota. MOVED by Young and seconded by Trautman to continue this item to the July 6, 2010, Board of Commissioners’ meeting. Vote: Unanimous. G. VACATION OF EASEMENT / VE 10-01: Timothy and Gail Foerster. To vacate an existing Power Line Easement traversing the subject property in order to rectify encroachment issues in accordance with the Pennington County Zoning Ordinance. Lot D, Woodland Valley Subdivision, Section 15, T2N, R6E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Young to sustain the Planning Commission recommendation to approve Vacation of Easement VE / 10-01 with the following two (2) conditions. Vote: Unanimous. 1) That the Vacation of Easement document (“Exhibit A”) to be recorded at the Register of Deeds, also show the location and boundaries of the new Right-of-Way Easement dedicated in 2002; and, 2) That the applicant obtains a Building Permit for the detached garage following the recording of the Vacation of Easement document at the Register of Deeds. H. LAYOUT PLAT / PL 10-14 AND SUBDIVISION REGULATIONS VARIANCE / SV 10-05: Cheryl and Todd Bachman; Sanders Family Trust. To reconfigure lot lines to create Tract Adonis and Tract Sunshine and to waive platting requirements in accordance with Sections 400.1 and 700.1 of the Pennington County Subdivision Regulations. EXISTING LEGAL: Adonis No. 3 Lode M.S. 1068 in Section 23 and Sunshine No. 8 Lode M.S. 1068 in Section 26, all located in T1N, R5E, BHM, Pennington County, South Dakota. PROPOSED LEGAL: Tract Adonis located in Section 23 and Tract Sunshine in Section 26, all located in T1N, R5E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Young to sustain the Planning Commission’s recommendation to approve of the portion of Subdivision Regulations Variance 10-05 to waive the requirement for the Section Line to be improved, for engineered road plans to be submitted and to waive the portion requirement for the access easement to be improved to meet Local/Collector road standards pertaining to the 24-foot-wide driving surface and denial of Subdivision Regulation Variance 10-05 to provide a 33-foot-wide access easement and recommends a 66 foot wide access easement be provided up to Tract Adonis and also approval of Layout Plat 10-14 with the following eight (8) conditions. Vote: Unanimous. 1) That prior to approval of the Minor Plat, the applicant improve the access easement to Local/Collector Road Standards, including 66 feet of right-of-way, and 24-feet of driving surface, or else the applicant post a surety for the road improvements or obtain an approved Subdivision Regulations Variance waiving this requirement; 2) That prior to County Board approval of the Minor Plat, the applicant provide engineered road construction plans for the access easement or else obtain an approved Subdivision Regulations Variance waiving this requirement; 3) That the access easement be named and the road sign posted prior to the recording of the Minor Plat; 4) That prior to approval of the Minor Plat, the applicant improve the Section Line to Ordinance 14 Standards or else obtain an approved Subdivision Regulations Variance waiving this requirement; 5) That Black Hills Electric Cooperative’s rights to operate and maintain the overhead line are not diminished or adversely affected in any way by the proposed subdivision; 6) That prior to applying for the Minor Plat, the applicant must perform percolation tests and provide soil profile information for proposed Tract Sunshine for review by the Pennington County Environmental Planner or obtain an approved Subdivision Regulations Variance waiving this requirement; 7) That at the time of submittal for the Minor Plat, the plat meets all the requirements of Section 400.3 of the Pennington County Subdivision Regulations, including, but not limited to, the plat to be scaled at not more than one (1) inch equals one hundred (100) feet, topographic information to be provided of the subject property at five (5) foot contour intervals, or else the applicant obtain an approved Subdivision Regulations Variance waiving any of the requirements that are not met; and, 8) That approval of this Layout Plat does not constitute approval of any further applications to be submitted for the above-described property. MOVED by Young and seconded by Trautman to approve Layout Plat 10-15 with the following thirteen (13) conditions pursuant to Planning Commission recommendation. Vote: Unanimous. 1) That at the time of Preliminary Plat submittal, engineered road construction plans be submitted for the both private access easements or a Subdivision Regulations Variance be obtained waiving this requirement; 2) That at the time of Preliminary Plat submittal, the applicant submits percolation tests and soil profile information or obtain approval of a Subdivision Regulations Variance waiving this requirement; 3) That at the time of Final Plat submittal, the plat be drawn in black ink only; 4) That addresses be posted at the driveway on both main roads; 5) That private access easements be improved to Local Road standards or obtain approval of a Subdivision Regulations Variance waiving this requirement; 6) That easements be included on the plat for both the water line and underground electric service; 7) The prior to filing the plat with Register of Deeds, the NE1/4 be rezoned to Low Density Residential District and the Comprehensive Plan be amended from Limited Agriculture District to Low Density Residential District; 8) That the roads names on the plat be labeled correctly; 9) That at the time of Preliminary Plat submittal, topography at a five foot contour interval be submitted or obtain approval of a Subdivision Regulations Variance waiving this requirement; 10) That at the time of Preliminary Plat submittal, water supply information be submitted or obtain approval of a Subdivision Regulations Variance waiving this requirement; 11) That the existing drainfields be located on the site plan; 12) That at the time of submittal of the Preliminary Plat, that a reserve area be designated on each lot for an alternative drainfield or obtain approval of a Subdivision Regulations Variance waiving this requirement; and, 13) That approval of this Layout Plat does not constitute approval of any further applications to be submitted for the above-described property. J. PLANNED UNIT DEVELOPMENT AMENDMENT / PU 10-01: Tammy Brodie-Gusmano; Leon Brodie – Owner. To amend a Planned Unit Development to allow for additional uses to occur on the property, such as Sunday Brunches, tea parties, a patio area for BBQs, and other special events to be hosted on the property. The applicant is also requesting an on-premise lighted sign and to allow the Rushmore Soccer Club to train once a week with no more than 20 players at a time in accordance with Section 213 of the Pennington County Zoning Ordinance. CANYON SPRINGS PRESERVE SURETY UPDATE: MOVED by Trautman and seconded by Young to continue this item to the June 1, 2010, County Board meeting at which time the following conditions will have been met: The water system will be finished, tested and working; road paving will be 100% completed, and copies of water testing results will have been provided to Planning Director Dan Jennissen, Todd Hanson and his attorney, John Burke. It was further moved that the developer is to notify Doty Volunteer Fire Department at least six hours prior to the water system being turned on. MOVED by Glassgow to call the question. Vote: Unanimous. Vote on the original motion: The motion carried 3-0 with Glassgow abstaining. L.
