PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES April 20, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, April 20, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Ethan Schmidt called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Nancy Trautman and Brenda Young. Vote: The motion carried 3-1 with Young voting no. C. BOND RESOLUTION DESIGNATING RECOVERY ZONE: MOVED by Trautman and seconded by Young to table this item. Vote: Unanimous. ROBERT SHARP VOUCHER: MOVED by Trautman and seconded by Young to approve the voucher for Robert Sharp & Associates in the amount of $5150.00 for web site development and authorize the Chairman’s signature on the proposal. Vote: Unanimous. ITEMS FROM HIGHWAY DEPARTMENT A. AWARD RECOMMENDATION FOR HAYING CONTRACT FOR LIBERTY BLVD & HWY 14/16: MOVED by Young and seconded by Holbrook to award the Haying Contract for Liberty Boulevard and Hwy 14/16 to Garold R. Shull. Vote: Unanimous. PENNINGTON COUNTY TAX INCREMENT FINANCE (TIF) DISTRICT #2 – JERRY WAGNER MOVED by Holbrook and seconded by Young to authorize Covington Consulting Group Inc. to renew the loan with US Bank at 6% interest for Tax Increment Finance District #2 until paid in full, with the following additional conditions upon the originator of the TIF and US Bank: 1. Loan is to be kept completely separate from any other funds and accounts; 2. County, and only the County, has full and complete access to account; 3. Full disclosure with monthly statements to Pennington County Auditor’s office; 4. Any monies received from the increment district will be applied immediately and fully against loan balance; 5. Detailed reporting of past TIF #2 loan debits and credits must be to Auditor by May 20, 2010; 6. Originator of TIF #2 is responsible for any payments on loan not satisfied by TIF payments received from the county; and, 7. Once verified (see #5), the originator of the TIF will be reimbursed any contributions made on behalf of the county. Vote: Unanimous. ITEMS FROM CHAIR A. VACANT COMMISSION POSITION PROCEDURE – ADVERTISING: MOVED by Holbrook and seconded by Trautman that an advertisement was sent to newspapers on April 12, 2010, requesting applications from individuals interested in serving as County Commissioner in District #4. It was further moved to accept applications until 5 p.m., April 30, 2010, and conduct interviews during the May 4, 2010, Board of Commissioners’ meeting. Vote: Unanimous. This appointment will serve until the end of 2010, with the office being placed on the November 2010 ballot to fill the remainder of the unexpired term ending in 2012. B. 2011 BUDGET HEARING DATES: MOVED by Trautman and seconded by Young to schedule 2011 budget hearings for May 25, 2010, and June 8, 2010. Vote: Unanimous. MISCELLANEOUS A. APPROVE VOUCHERS: MOVED by Young and seconded by Trautman to approve the vouchers listed at the end of the minutes for expenditures for insurance, professional services, publications, rentals, supplies, repairs, maintenance, travel, conference fees, utilities, furniture and equipment, and authorize the chair’s signature thereto. Vote: Unanimous. ITEMS FROM PLANNING AND ZONING MOVED by Trautman and seconded by Young to convene as a Board of Adjustment. Vote: Unanimous. A. VARIANCE / VA 10-08: Todd and Barb Duda. To reduce the side yard setback from 25 feet to 8 feet in a Low Density Residential District to bring a detached garage into compliance in accordance with Sections 207 and 509 of the Pennington County Zoning Ordinance. Lot 9, Block 1, Norris Peak Subdivision located in Section 29, T2N, R6E, BHM, Pennington County, South Dakota. MOVED by Young and seconded by Trautman to approve Variance 10-08 with two (2) conditions of approval. Vote: Unanimous. 1) That a Building Permit be obtained for any structure exceeding 144 square feet or located on a permanent foundation, which includes the necessary site plans to be reviewed and approved by the Planning Director; and, 2) That this Variance only applies for the portion of the side yard setback requirement that will be encroached upon by the garage. All other structures must maintain the proper setback requirements or obtain separate Variance(s) for that structure. B. VARIANCE / VA 10-09: M.G. Oil Company/Troy Erickson. To reduce the side yard setback from 10 feet to 1 foot in a Highway Service District to allow for an addition to be constructed onto the existing convenience store in accordance with Sections 210 and 509 of the Pennington County Zoning Ordinance. Lot 1, Flannery Subdivision located in Section 29, T1N, R7E, BHM, Pennington County, South Dakota. MOVED by Young and seconded by Trautman to withdraw Variance 10-09 at the request of the applicant. To locate a public highway located between Sections 4 and 5 of T1S, R8E, BHM, Pennington County, South Dakota. Located on the following metes and bounds description: A tract of land located in the East One-Half (E½) of Section Five (5) and in the West One-Half (W½) of Section Four (4) of Township One South (T1S), Range Eight East (R8E) of the Black Hills Meridian (BHM), Pennington County, South Dakota, more fully described as follows: Commencing at the one-quarter section corner common to the above described Sections Five (5) and Four (4), thence south on the common section line a distance of twenty feet (20’) to the point of beginning. MOVED by Young and seconded by Trautman to continue the review of Planned Unit Development Amendment 08-04 to the June 1, 2010, Board of Commissioners’ meeting, pursuant to Planning Commission recommendation. Vote: Unanimous. F. ROAD NAME: Turkey Hill Trail: Proposed road naming for the 40-foot-wide and 66-foot- wide private access easement that provides access to properties located in Section 31, T2N, R7E and Section 6, T1N, R7E, all in BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Young to continue this item to the May 18, 2010, Board of Commissioners’ meeting pursuant to Planning Commission recommendation. Vote: Unanimous. G. LAYOUT PLAT / PL 10-13 AND SUBDIVISION REGULATIONS VARIANCE / SV 10- 04: A. Alan and Sally Kelts; Fisk Land Surveying – Agent. To reconfigure lot lines to create Lot 1 – Revised, Block 3 of Plat No. 2 of Pine Cliff Subdivision and to waive platting requirements in accordance with Sections 400.1 and 700.1 of the Pennington County Subdivision Regulations. EXISTING LEGAL: Lot 1 of Block 3 of Pine Cliff Subdivision and a portion of Green Tract A of Lot A of Plat No. 2 of Pine Cliff Subdivision, Section 31, T2N, R6E, BHM, Pennington County, South Dakota. MOVED by Young and seconded by Holbrook to approve Subdivision Regulations Variance 10- 04 to waive percolation tests, soil profile information, engineered road construction plans, road improvements, paved surface, sidewalks, curbs, 24 foot-wide driving surface, two foot deep road ditches, fire flow requirements, 40 units served by a dead end road and to allow a 40 foot access easement to serve more than two lots and an 18 foot driving surface and approval of Layout Plat 10-13 with the following eight (8) conditions, pursuant to Planning Commission recommendation. Vote: Unanimous. 1) That at the time of Minor Plat submittal, engineered road construction plans be submitted for the both Wild Flower Lane and Pine Cliff Drive or a Subdivision Regulations Variance be obtained waiving this requirement; 2) That at the time of Minor Plat submittal, the applicant submits percolation tests and soil profile information or obtain approval of a Subdivision Regulations Variance waiving this requirement; 3) That at the time of Minor Plat submittal, the applicant remove the dash between Lot 1 and Revised in the title of the plat; 4) That at the time of submittal of the Minor Plat, the applicant meet fire flow requirements or obtain approval of a Subdivision Regulations Variance waiving this requirement; 5) That Wild Flower Lane and Pine Cliff Drive be improved to Local Road standards or obtain approval of a Subdivision Regulations Variance waiving this requirement; 6) That a second means of ingress/egress be provided or obtain approval of a Subdivision Regulations Variance waiving this requirement; 7) That prior to recording the plat with the Register of Deeds, the utility/drainage easement where the propane tank and storage shed are located be vacated, and if the applicants do not relocate the shed on the property to meet the setback, the applicants need to apply for and obtain approval of a Setback Variance; and, 8) That a Building Permit be obtained for the storage shed. H. PLANNED UNIT DEVELOPMENT AMENDMENT / PU 10-01: Tammy Brodie- Gusmano; Leon Brodie – Owner. To amend a Planned Unit Development to allow for additional uses to occur on the property, such as Sunday Brunches, tea parties, a patio area for BBQs, and other special events to be hosted on the property. The applicant is also requesting an on-premise lighted sign and to allow the Rushmore Soccer Club to train once a week with no more than 20 players at a time in accordance with Section 213 of the Pennington County Zoning Ordinance. Lot 6 of Tract A, Knights Acres Subdivision, Section 14, T1N, R8E, BHM, Pennington County, South Dakota. MOVED by Young and seconded by Holbrook to approve the amendment of Condition #5 of the original Conditions of Approval of the PUD and remove the wording “the storing, bottling, and shipping of wine, and a vineyard” from that condition, and further moved to approve of Planned Unit Development Amendment 10-01 with ten (10) conditions, pursuant to Planning Commission recommendation. Young and Holbrook later agreed to withdraw the motion. MOVED by Holbrook and seconded by Schmidt to return this item to the Planning Commission to review the applicant’s concerns regarding the conditions. MOVED by Holbrook and seconded by Young to call the question. Vote: The motion to call the question failed on a 3-1 vote with Schmidt voting no (2/3 affirmative votes required). Vote: Unanimous. GENERAL FUND SURPLUS ANALYSIS The amount of General Fund dollars that counties can retain as surplus is restricted by SDCL 7- 21-18.1 which states: “The total unreserved, undesignated fund balance of the General Fund may not exceed forty percent of the total amount of all General Fund appropriations contained in the budget for the next fiscal year. The total unreserved, undesignated fund balance of the General Fund of the County as of March thirty-first and September thirtieth shall be published in the minutes of the proceedings of the Board of County Commissioners and reported to the Department of Legislative Audit. The report shall be on forms prescribed by the Department of Legislative Audit.” The following analysis should be completed as of March thirty-first and September thirtieth of each year.
