PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES January 5, 2010 A meeting of the Pennington County Board of Commissioners was held on Tuesday, January 5, 2010, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Ethan Schmidt and Nancy Trautman. ELECTION OF OFFICERS BY AUDITOR The floor was opened by Auditor Julie Pearson for nominations for Chairperson by ballot. MOVED by Young to nominate Trautman for Chairperson. MOVED by Kjerstad to nominate Schmidt for Chairperson. MOVED by Young and seconded by Schmidt that nominations cease and ballots be cast. Vote: Unanimous. Vote by ballot was taken and Ethan Schmidt was voted in as Chairperson by ballots cast: Schmidt, 3; Trautman, 2. Chairperson Schmidt opened the floor for nominations for Vice Chairperson. MOVED by Holbrook to nominate Trautman for Vice Chairperson. MOVED by Kjerstad and seconded by Holbrook that nominations cease and a unanimous ballot be cast for Nancy Trautman as Vice Chairperson. Vote: Unanimous. ADOPT RULES OF ORDER MOVED by Kjerstad and seconded by Holbrook to adopt Roberts Rules of Order, 10th Edition, but not to adopt the portion that precludes discussion of issues by the chair or precludes the chair from voting except where there is a tie, and including the policy regarding reconsideration of action take by the Board as follows. Vote: Unanimous. PENNINGTON COUNTY BOARD OF COMMISSIONERS POLICY REGARDING RECONSIDERATION OF ACTION TAKEN BY THE BOARD It shall be the policy of the Pennington County Board of Commissioners that reconsideration of action taken by the Board is authorized in the following manner: Any member of the Board voting on the prevailing side of an item may move for reconsideration of that item before adjournment of the scheduled meeting at which the item was originally voted upon. A second motion for reconsideration requires the unanimous consent of the Board. Any member of the Board voting on the prevailing side of an item may give notice of intent to move for reconsideration before the Board proceeds to the next item of business. The effect of giving notice of intent to reconsider is to hold in abeyance the finality of the vote. The Board member who gave notice may move for reconsideration not later than the next regular scheduled Board meeting. The matter subject to the notice of intent to reconsider shall be placed on the Board agenda for the next regular scheduled meeting. If any member has given notice of intent to move for reconsideration and does not move for reconsideration of that item at the time the item comes up at the next scheduled meeting, the presiding officer shall immediately state that any member voting on the prevailing side may move for reconsideration. No motion to reconsider the same item may be made twice without unanimous consent of the Board. REVIEW MINUTES MOVED by Holbrook and seconded by Young to approve the minutes of the December 15, 2009 Board of Commissioners' meeting. Vote: Unanimous. ESTABLISH COMMISSIONERS SALARY MOVED by Young to set the 2010 commissioners’ salary at the same rate as 2008 and 2009 at $1100 per month and to increase the chairperson’s salary by $200 per month. Motion died for lack of a second. MOVED by Kjerstad and seconded by Holbrook to set the 2010 salary for Commissioners at the same rate as 2008 and 2009 at $1100/month, $13,200/year. Vote: Yes: Holbrook, Kjerstad, Schmidt and Trautman. No: Young. Motion carried 4 to 1. DESIGNATE LEGAL NEWSPAPERS (3) MOVED by Holbrook and seconded by Young to designate the Rapid City Journal, the Pennington County Courant, and the Hill City Prevailer (Southern Hills Publishing, Inc.) as the three legal newspapers for Pennington County for 2010. Vote: Unanimous. RESOLUTION – DRUG FREE WORKPLACE CERTIFICATION MOVED by Holbrook and seconded by Young to approve the resolution for Drug Free Workplace Act Certification for A Public Entity. Vote: Unanimous. RESOLUTION DRUG-FREE WORKPLACE ACT CERTIFICATION FOR A PUBLIC ENTITY 1. The County of Pennington Certifies that it will provide a drug-free workplace by: a. Publishing a statement notifying employees that unlawfully manufacturing, distributing, dispensing, possessing or using a controlled substance in the recipient’s workplace is prohibited and specifying the actions that will be taken against employees for violation or such prohibition. b. Establishing a drug-free awareness program to inform employees about: 1. The dangers of drug abuse in the workplace; 2. The recipient’s policy of maintaining a drug-free workplace; 3. Any drug counseling, rehabilitation and employee assistance programs that are available; and 4. The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace. c. Making it a requirement that each employee to be engaged in the performance of the grant or cooperative agreement be given a copy of the statement required by paragraph (a). d. Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under the grant or cooperative agreement, the employee will; 1. Abide by the terms of the statement; and, 2. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such a conviction. e. Notifying the federal sponsoring agency within ten days after receiving notice under subparagraph (d) (2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other appropriate agency. f. Taking one of the following actions, within 30 days of receiving notice under subparagraph (d)(2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other agency. g. Making a good faith effort to continue to maintain a drug-free workplace through implementation of paragraphs (a), (b), (c), (d), (e), and (f). 2.
