PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES September 15, 2009 A meeting of the Pennington County Board of Commissioners was held on Tuesday, September 15, 2009, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Nancy Trautman and Ethan Schmidt. REVIEW AND APPROVE AGENDA MOVED by Holbrook and seconded by Trautman to approve the agenda as amended: remove Item 10) Lien Release Request (DEM); add Item 6B) Items from Auditor, Hidden Valley Trails Election Results; and Item 16B) Executive Session, Contractual. Vote: Unanimous. REVIEW & AMENDMENT OF MINUTES MOVED by Trautman and seconded by Holbrook to approve the minutes of the September 1, 2009 Board of Commissioners’ Meeting with the following corrected. DARK CANYON ROAD DISTRICT - ORDER FOR ORGANIZATION AND INCORPORATION: MOVED by Kjerstad and seconded by Holbrook to accept the Official Returns of the organizational election of the Dark Canyon Road District and issue the Order for Organization and Incorporation effective with taxing authority for the 2009 pay 2010 tax year and after. Vote: Unanimous. Abstain: Commissioner Young. ORDER FOR ORGANIZATION AND INCORPORATION OF THE DARK CANYON ROAD DISTRICT PENNINGTON COUNTY, SOUTH DAKOTA WHEREAS, the Official Return from the organizational election indicates the desire of the majority of the qualified voters voting in the proposed area to organize the Dark Canyon Road District. NOW, THEREFORE, BE IT ORDERED, the Pennington County Commissioners declare that the Dark Canyon Road District is organized as a governmental subdivision of the State of South Dakota and a public body, corporate and political to be effective August 10, 2009 with taxing authority for the 2009 pay 2010 tax year and after. MOVED by Trautman and seconded by Kjerstad to allow the Commission Chairperson to enter into a Memorandum of Understanding with Western Dakota Tech (WDT) d/b/a Rapid City Area Schools and the Rapid City Public Library for the operation of a joint use facility (library) on the WDT campus with Pennington County to contribute $ 1,000,000.00 to the construction of the facility and for the County to continue providing library services to County residents including maintaining the existing agreement for library services with the Rapid City Public Library through year 2016.
