PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES August 18, 2009 A meeting of the Pennington County Board of Commissioners was held on Tuesday, August 18, 2009, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Jim Kjerstad, Nancy Trautman and Ethan Schmidt. INDIAN CREEK LAND EXCHANGE PROJECT (CON’T FROM 8-4-09): MOVED by Schmidt and seconded by Trautman to approve and authorize Deputy States Attorney Jay Alderman’s letter opposing the land exchange to the US Forest Service appealing their decision, with copies to the same recipients as the 2004 letter opposing this land exchange. Vote: Unanimous. ITEMS FROM THE BOARD OF ADJUSTMENT MOVED by Trautman and seconded by Schmidt to convene as the Board of Adjustment. Vote: Unanimous. A. VARIANCE / VA 09-17: Ramona Stoner. To reduce the minimum required front yard setback from 25 feet to 19 feet to bring into compliance a deck in a Suburban Residential District in accordance with Sections 208 and 509 of the Pennington County Zoning Ordinance. Lot 23, Block 3, Meadow Ridge, Section 2, T1N, R8E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Kjerstad to accept staff recommendation to approve VA 09-17 to reduce the front yard setback from 25 feet to 19 feet to allow for the construction of a covered deck onto the existing residence with the following two (2) conditions: 1. That a Building Permit be obtained for any structure exceeding 144 square feet or located on a permanent foundation, which requires a site plan to be reviewed and approved by the Planning Director; and, 2. That this Variance only applies for the portion of the setback requirement that will be encroached upon by construction of the deck onto the existing residence. All other structures must maintain the proper setback requirements or obtain separate Variance(s) for that structure. Vote: Unanimous. B. VARIANCE / VA 09-18: DenKim Corporation (Dennis Krull). To reduce the minimum required front yard setback from 25 feet to 12.5 feet and to reduce the minimum required side yard setback from 10 feet to 4 feet in a General Commercial District in accordance with Sections 209 and 509 of the Pennington County Zoning Ordinance. Lot B of NW1/4NE1/4, Section 9, T1N, R6E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Schmidt to approve VA 09-18 with the following three (3) conditions: 1. That the vacation document be filed at Register of Deeds; 2. That prior County Board approval or denial of this Variance, the applicant must pay the doubled-fee, plus the $500.00 late fee; and, 3. That the applicant obtains a Building Permit for the refrigeration unit. Vote: Unanimous. MOVED by Schmidt and seconded by Trautman to adjourn as a Board of Adjustment and reconvene as the Board of Commissioners. Vote: Unanimous. ITEMS FROM PLANNING & ZONING C. FIRST READING AND PUBLIC HEARING OF ORDINANCE AMENDMENT / OA 09-04. Pennington County. To amend Section 316-F “Telecommunications Facility” of the Pennington County Zoning Ordinance. MOVED by Trautman and seconded by Schmidt to accept Planning Commission recommendation to approve OA 09-04 to amend Section 316.F.3 to state that Stealth Telecommunications Facilities up to 75 feet in height that are sufficiently disguised to minimize the visual impact shall be permitted in all zoning districts after Administrative Review and Administrative Approval in accordance with the following requirements: a. Antennas must be enclosed, camouflaged, screened, obscured or otherwise not readily apparent to a causal observer; b. The structure utilized to support the Antennas must be allowed within the underlying zoning district. Such structures may include, but are not limited to: flagpoles, bell towers, clock towers, crosses, monuments, smoke stacks, parapets, steeples and “naturally occurring features” such as boulders and trees; c. The minimum setbacks requirement shall be 1.1 times the tower’s height from all property lines. Vote: Unanimous. D. PLANNED UNIT DEVELOPMENT AMENDMENT REVIEW / PU 08-07: Robert and Susan Duncan/Talking Leaves Boutique. To review a Planned Unit Development Amendment to allow for an illuminated, on-premise sign and to reduce the front-yard setback requirement for an on-premise sign in accordance with Section 213 of the Pennington County Zoning Ordinance. Lot B of Lot 1 of Lot C of Lot 8 of Lot E; Lot 2 of Lot C of Lot 8 of Lot E; and the unplatted portion of Lot C of Lot 8 of Lot E, Big Bend Placer MS 1442, Section 8, T1N, R6E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Kjerstad to accept Planning Commission recommendation to approve the extension of Planned Unit Development Review 08-07 with the following eight (8) conditions: 1. That all lighting be installed and maintained so as to minimize spillage of light outside of the sign face so as not to create a nuisance and the sign must be effectively shielded to prevent beams or rays from being directed toward any portion of the traveled ways, and must not be of such intensity or brilliance to cause glare or impair the vision of the driver of any motor vehicle or otherwise interfere with any driver’s operation of a motor vehicle; 2. That the existing sign be allowed a zero (0) foot setback from the front property line as long as no part of the sign structure encroaches into the public right-of-way and that any other signs installed on the property must meet a minimum five (5) foot setback from the front property line and maintain proper setbacks from all side and rear property lines; 3. That the sign conform to all regulations in Section 312 of the Pennington County Zoning Ordinance, including, but not limited to Section 312-A-19, which states: “Electronic variable message signs… are permitted, provided such signs do not interfere with traffic safety, do not change messages less than every six (6) seconds and do not resemble or stimulate traffic control or safety devices…;” 4. That the sign structure shall be painted and maintained in muted colors as to blend into the natural surroundings; 5. That the sign be maintained so as to have an aesthetically pleasing appearance at all times and not appear dilapidated; 6. That only on-premise advertising be allowed on the proposed sign and no off-premise advertising be allowed, unless otherwise permitted with Pennington County; 7. That all other existing conditions of the original PUD for Talking Leaves Boutique are still valid and applicable to the subject property; and, 8. That this Planned Unit Development Amendment be reviewed on a complaint basis only. Vote: Unanimous. E. LAYOUT PLAT / PL 09-14: Ford Mountain Ranch Partnership. To create Tract A of Ford Ranch Subdivision in accordance with Section 400.1 of the Pennington County Subdivision Regulations. EXISTING LEGAL: N1/2SW1/4; SE1/4SW1/4; NW1/4SE1/4, Section 32, T1S, R5E, BHM, Pennington County, South Dakota. PROPOSED LEGAL: Tract A of Ford Ranch Subdivision, Section 32, T1S, R5E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Trautman to continue this item to the September 1, 2009, Board of Commissioners’ meeting. Vote: Unanimous. F. LAYOUT PLAT / PL 09-20: Frank Boyle. To create Lot 1 of Boyle Subdivision in accordance with Section 400.1 of the Pennington County Subdivision Regulations. EXISTING LEGAL: Lot 1 of Lot M and Lot 2 of Lot M of Trout Haven Subdivision and Lot L of SW1/4SW1/4 all located in Section 7, T2N, R5E, BHM, Pennington County, South Dakota. PROPOSED LEGAL: Lot 1, Boyle Subdivision, Section 7, T2N, R5E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Holbrook to accept Planning Commission recommendation to approve PL 09-20 with the following nine (9) conditions: 1. That the applicant also work with Lawrence County to plat the proposed lot and the final plat document be recorded at the Lawrence County Register of Deeds; 2. That prior to approval of the Minor Plat, the applicant improves the Section Line to Ordinance 14 Standards or else obtain an approved Subdivision Regulations Variance waiving this requirement; 3. That the Minor Plat be drawn in accordance with the requirements of Section 400.3 of the Pennington County Subdivision Regulations, including all certifications with the exception of Section 400.3–n-10. Certificate of Planning Director; 4. That eight (8) foot utility easements be dedicated on the interior sides of all lot lines on the Minor Plat or an approved Subdivision Regulations Variance be obtained waiving this requirement; 5. That the Minor Plat show the boundaries of the 100- year floodplain and include a notation to read: “Prior to any work being done within the limits of the 100-year floodplain, an approved Floodplain Development Permit must be obtained;” 6. That a drainage or conservation easement be dedicated on the Minor Plat around the pond and Jim Creek to the high water line in accordance with Section 500.6 of the Pennington County Subdivision Regulations; 7. That prior to approval of the Minor Plat, the portion of proposed Lot 1 of Boyle Subdivision zoned General Agriculture District (existing Lot L), be rezoned to a zoning district in which it will meet the minimum lot requirements; 8. That the uses occurring on the subject properties be in compliance with the current zoning and that the property be rezoned to an appropriate zoning district if the applicant desires to utilize the subject properties for any uses not allowed within the current zoning districts; and, 9. That approval of this Layout Plat does not constitute approval of any further applications to be submitted for the above- described property. Vote: Unanimous. G. FIRST READING AND PUBLIC HEARING OF REZONE / RZ 09-06 AND COMPREHENSIVE PLAN AMENDMENT / CA 09-04: Art Janklow. To rezone 3.13 acres from Suburban Residential District to General Commercial District and to amend the Comprehensive Plan to change the Future Land Use from Suburban Residential District to General Commercial District in accordance with Sections 208 and 508 of the Pennington County Zoning Ordinance. Tract B of Lot B of NE1/4NW1/4, Section 17, T2N, R7E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Kjerstad to accept Planning Commission recommendation to approve RZ 09-06 to rezone 3.13 acres from Suburban Residential District to General Commercial District and approve CA 09-04 to change the Future Land Use from Suburban Residential District to General Commercial District. Vote: Unanimous. AMERICAN RECOVERY AND REINVESTMENT ACT (RECOVERY ZONE ECONOMIC DEVELOPMENT BOND)(CON’T FROM 8-4-09) MOVED by Trautman and seconded by Holbrook to send a letter to cities within Pennington County to inform of access to 11M in facility bonds and request of the cities, if they have a desired project in their area, to respond back to the Pennington County Commission with a description and dollar amount of their desired project by November 30, 2009.
