PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES January 6, 2009 A meeting of the Pennington County Board of Commissioners was held on Tuesday, January 6, 2009, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Nancy Trautman, Gale Holbrook, Jim Kjerstad and Ethan Schmidt. ELECTION OF OFFICERS BY AUDITOR The floor was opened by Auditor Julie Pearson for nominations for Chairperson. MOVED by Kjerstad to nominate Schmidt for Chairperson. MOVED by Trautman to nominate Young for Chairperson. MOVED by Schmidt and seconded by Trautman that nominations cease and ballots be cast. Vote: Unanimous. Ballot was taken and Young was voted in as Chairperson. Vote: 3 to 2. Chairperson Young opened the floor for nominations for Vice Chairperson. MOVED by Holbrook to nominate Trautman for Vice Chairperson. MOVED by Young and seconded by Kjerstad that nominations cease and a unanimous ballot be cast for Trautman. Vote: Unanimous. ADOPT RULES OF ORDER MOVED by Holbrook and seconded by Trautman to adopt the current Roberts Rules of Order but not to adopt the portion that precludes discussion of issues by the chair or precludes the chair from voting except where there is a tie. Vote: Unanimous. REVIEW AND APPROVE AGENDA MOVED by Holbrook and seconded by Schmidt to approve the agenda with the following additions and changes: Add Item 14f. REVIEW MINUTES MOVED by Trautman and seconded by Kjerstad to approve the minutes of the December 16, 2008 Board of Commissioners' meeting. Vote: Unanimous. ESTABLISH COMMISSIONERS SALARY MOVED by Kjerstad and seconded by Schmidt to set the salary for Commissioners for 2009 at the same rate as 2008 at $1,100 per month or $13,200 per year. Vote: Unanimous. DESIGNATE LEGAL NEWSPAPERS (3) MOVED by Schmidt and seconded by Holbrook to designate the Rapid City Journal, the Pennington County Courant and the Southern Hills Publishing, Inc. as the three legal newspapers for Pennington County for 2009. Vote: Unanimous. RESOLUTION – DRUG FREE WORKPLACE CERTIFICATION MOVED by Schmidt and seconded by Holbrook to approve the resolution for Drug Free Workplace Act Certification for A Public Entity. Vote: Unanimous. DRUG-FREE WORKPLACE ACT CERTIFICATION FOR A PUBLIC ENTITY 1. The County of Pennington Certifies that it will provide a drug-free workplace by: a. Publishing a statement notifying employees that unlawfully manufacturing, distributing, dispensing, possessing or using a controlled substance in the recipient’s workplace is prohibited and specifying the actions that will be taken against employees for violation or such prohibition. b. Establishing a drug-free awareness program to inform employees about: 1. The dangers of drug abuse in the workplace; 2. The recipient’s policy of maintaining a drug-free workplace; 3. Any drug counseling, rehabilitation and employee assistance programs that are available; and 4. The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace. c. Making it a requirement that each employee to be engaged in the performance of the grant or cooperative agreement be given a copy of the statement required by paragraph (a). d. Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under the grant or cooperative agreement, the employee will; 1. Abide by the terms of the statement; and, 2. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such a conviction. e. Notifying the federal sponsoring agency within ten days after receiving notice under subparagraph (d) (2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other appropriate agency. f. Taking one of the following actions, within 30 days of receiving notice under subparagraph (d)(2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other agency. g. Making a good faith effort to continue to maintain a drug-free workplace through implementation of paragraphs (a), (b), (c), (d), (e), and (f). 2. RANDOM DRUG TESTING AGREEMENT: MOVED by Trautman and seconded by Schmidt to authorize the Pennington County Department Heads to utilize Clinical Laboratory of the Black Hills for drug testing in 2009 at the costs of: $10 – Drug Screen Collection Fee for both DOT and Non-DOT (#708008); $26 – DOT Drug Screen (#794800); $26 – Non-DOT Drug Screen 5-Panel (#D10021); $25 – BAT (Breath Alcohol Testing) for Pennington County employees. UPDATE ON RESERVOIR ROAD PROJECT: MOVED by Schmidt and seconded by Holbrook to authorize the Pennington County Highway Superintendent to sign all right-of-ways and temporary easement agreements on behalf of Pennington County. BLACK HILLS 2009 TATTOO CONVENTION (LICENSING FEE) – HEATHER TAYLOR MOVED by Kjerstad and seconded by Schmidt to authorize reducing the fee for a tattoo license for the participants of this event from $275 to $150 for this event only, to be held October, 2009 at the Rushmore Plaza Civic Center, with the Pennington County Ordinance Officer performing inspections. COURTHOUSE HISTORIC PRESERVATION PROJECT: MOVED by Schmidt and seconded by Holbrook to authorize the use of the courthouse renovation project information for a booth at the Black Hills Homebuilders Show. ADVOCACY CONTRACT-DAKOTA PLAINS LEGAL SERVICES: MOVED by Kjerstad and seconded by Holbrook to approve the Agreement to Extend Contract and Modify for Indigent Representation with Dakota Plains Legal Services in the amount of $15,500 per month for a 4-year term expiring December 31, 2012 and authorize the chair’s signature thereon. Vote: Unanimous. COUNTY LIAISON RAPID CITY LIBRARY BOARD MOVED by Schmidt and seconded by Trautman to appoint Robert Van Norman as the Pennington County Liaison to the Rapid City Public Library Board and require he submit a quarterly report of meetings. Vote: Unanimous. MOVED by Trautman and seconded by Holbrook to authorize the chair’s signature to a letter to the Rapid City Library Board requesting the County Liaison become a voting member of the Board. DISCUSSION – NACO AND SDACC ANNUAL DUES (COMMISSIONER KJERSTAD): MOVED by Kjerstad and seconded by Schmidt to authorize the chair’s signature and payment of the 2009 annual dues to the National Association of Counties in the amount of $1857. MOVED by Kjerstad and seconded by Trautman to withhold the payment of the 2009 annual dues to the South Dakota Association of County Commissioners in the amount of $12,013.45 and invite the director and/or staff to a meeting here at the Pennington County Courthouse to discuss issues concerning their services. To reduce the minimum required front yard setback along Sherman Street from 25 feet to 17 feet and to reduce the front yard setback from the alleyway from 25 feet to 16 feet to allow for the construction of a new residence in a Suburban Residential District in accordance with Sections 208 and 509 of the Pennington County Zoning Ordinance. That the address be properly posted in accordance with Ordinance #20; 8. That a minimum of two (2) off-street parking spaces be provided. Each space shall measure at least nine (9) feet by eighteen (18) feet and be maintained in a dust free manner; 9. That emergency radio communication equipment be allowed on the tower so long as it does not interfere with the applicant’s broadcast equipment; 10. That proper setbacks from the property lines and all utilities be maintained for all structures located on the property; 11. That an access easement be dedicated and recorded at the Register of Deeds ensuring the applicant has legal access to the telecommunications facility prior to applying for a Building Permit for said facility; 12. That the use of the subject property as a telecommunications facility must be limited and/or designed to preclude any interference from S.D. Highway 44 and Covington Street from functioning as a principal arterial street and a collector street, respectively; 13. That an Air Quality Permit be obtained from the City of Rapid City prior to any surface disturbance in excess of one acre; 14. That any future additions of equipment to the site or tower require this Planned Unit Development to be reviewed by the Pennington County Planning Department; 15. That all other existing conditions of the original Trailwood Village PUD and previous PUD Amendments for Trailwood Village are still valid and applicable to the subject property; 16. That all unlicensed vehicles be licensed or removed from the property before the applicant applies for a Building Permit for the telecommunications tower and that the property be kept free of unlicensed vehicles and debris at all times; 17. That the applicant works with the Rapid Valley Sanitary District to determine and regulate any interference with the radio waves for their water system; 18. That the applicant allows the co-location of other service providers on the tower; 19. That this Planned Unit Development Amendment is not valid until the applicant signs the Statement of Understanding, which is available at the Planning Office; and, 20. That this Planned Unit Development Amendment be reviewed in two (2) years or on a complaint basis to determine that all conditions are being met.
