PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES November 18, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, November 18, 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Jim Kjerstad, Ethan Schmidt, and Nancy Trautman. Gale Holbrook arrived late. REVIEW AND APPROVE AGENDA MOVED by Schmidt and seconded by Trautman to reconsider Subdivision Regulations Variance 08-13 and place it under items from Planning and Zoning. Vote: Unanimous. MOVED by Trautman and seconded by Kjerstad to remove Item 12, Visiting Artist License Fee for Black Hills Tattoo Convention (Heather Taylor), from the agenda. Vote: Unanimous. REVIEW MINUTES Holbrook arrived at 9:07 a.m. MOVED by Trautman and seconded by Schmidt to approve the minutes of the November 10, 2008, Board of Commissioners’ meeting. Vote: Unanimous. MOVED by Schmidt and seconded by Kjerstad to approve VA 08-31 with the following five conditions: 1. PLANNING AND ZONING D. ROAD CONSTRUCTION WITHIN A SECTION LINE / CS 08-01: Lana and Paul Wright. To construct a road within the Section Line Right-of-Way located between Sections 20 and 21. Starting in T2N, R7E and ending at the south boundary of the W1/2NE1/4 and the NW1/4 of Section 21, T2S, R7E, BHM, Pennington County, South Dakota in a Limited Agriculture District/General Agriculture District in accordance with Section 500.5 of the Pennington County Subdivision Regulations. W1/2NE1/4NW1/4, T2S, R7E, Section 21, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Trautman to accept staff recommendation to approve CS 08-01 with the following nine conditions: 1. That the road be constructed in accordance with accordance with the Pennington County Ordinance 14 Standards which includes 66 feet of right- of-way with 24 feet of driving surface and 4 inches of gravel as well as in accordance with the submitted road plans; 2. That erosion control measures be implemented to prevent silt from leaving the applicant’s property and erosion control measures be maintained on the area of the proposed roadway construction; 3. That any natural drainage ways and paths be continually maintained and culverts added as necessary, in accordance with Pennington County Ordinance #14; 4. That the applicant pays for any regulatory, warning, and information road signs as determined by the Pennington County Highway Department and the Department of Transportation; 5. If the area to be disturbed by the proposed construction of the road is 1-acre or larger, the applicant will be required to obtain a Storm Water Construction Permit from the South Dakota Department of Environment and Natural Resources (DENR); 6. That the applicant understands that approval of this road construction within a Section Line Right-of-Way does not constitute approval of any future applications to be submitted on the above-described properties; 7. That any monuments establishing property boundaries be replaced as necessary; 8. That any fence material removed during the construction of the road be relocated by the applicant; and, 9. That an Approach Permit be obtained through the South Dakota Department of Transportation. Vote: Holbrook, Kjerstad, Trautman and Young, yes. Schmidt abstained. Motion carried. E.
