PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES October 21, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, October 21, 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Ethan Schmidt, and Nancy Trautman. REVIEW AND APPROVE AGENDA MOVED by Holbrook and seconded by Schmidt to approve the agenda with the following additions: Discussion on Initiated Measure 10; and, Special Approval of Voucher. Vote: Unanimous. REVIEW MINUTES MOVED by Trautman and seconded by Schmidt to approve the minutes of the October 7, 2008, Board of Commissioners’ meeting. Vote: Unanimous. ITEMS FROM THE AUDITOR A. SUPPLEMENT REQUESTS SP 08-13: MOVED by Schmidt and seconded by Trautman to supplement the General Fund Juvenile Diversion/Teen Court Budget in the amount of $9,980 from non-budgeted revenue received in the current year. Vote: Unanimous. B. SPECIAL APPROVAL OF VOUCHER: MOVED by Holbrook and seconded by Trautman to approve payment of $211.66 for meals that exceeded the maximum one hundred dollar amount as set in policy. Vote: Unanimous. To create four lots in accordance with Section 400.3 Pennington County Subdivision Regulations. EXISTING LEGAL: NE1/4NE1/4 in Section 35; That Part of SE1/4SE1/4 lying south of Deerfield Road in Section 26, all located in T1N, R3E, BHM, Pennington County, South Dakota. That approved On- Site Wastewater Construction Permits be obtained prior to any wastewater system being installed on proposed Lots 1, 2 and 4 or alterations being conducted to the existing wastewater system located on proposed Lot 3; 2. That conventional septic systems not be allowed on proposed Lots 1 and 2 due to the high groundwater table and an alternate means of on-site wastewater systems be utilized on these lots, such as mound systems, evapotransporation systems or holding tanks; 3. That any non-conventional septic systems obtain approval from both the South Dakota Department of Environment and Natural Resources and the Pennington County Planning Department; 4. That any alternative septic system be designed and certified by a Registered Professional Engineer and be accompanied by engineered soil profile information and percolation tests and that a note be included on the plat document which states: “Alternative septic systems must be designed by a Registered Professional Engineer.;” 5. That no on-site wastewater system may be located within the limits of the 100-year floodplain and must maintain a minimum 100-foot separation from the septic system to the high water line of the creek; 6. That prior to approval of a Building Permit on either proposed Lot 1 or 2, two (2) suitable on-site wastewater system areas must be identified with accompanying percolation tests and soil profiles, and the plat document be revised to include a notation to read: “Prior to obtaining a Building Permit on any of the lots, two suitable on-site wastewater system areas must be identified with accompanying percolation tests and soil profiles. Soil profiles must show that proper soil separation can be obtained as outlined in State Administrative Rule 74:53:01:15. Percolation tests must meet acceptable rates as shown in State Administrative Rule 74:53:01:32. If the percolation and soil profile information do not meet these requirements, an alternative system approved by the Department of Environment and Natural Resources could be used. As a last resort, Pennington County may approve the use of holding tanks;” 7. That an approved Floodplain Development Permit be obtained prior to any work that is to be done within the boundaries of the 100-year floodplain; 8. That the applicant signs and complies with the Noxious Weed Management Plan provided by the Pennington County Weed and Pest Department; 9. That proposed Lots 1 and 2 and proposed Lots 3 and 4 share an approach so that the number of approaches onto Deerfield Road for this subdivision be limited to two (2) unless otherwise approved by the County Highway Department; 10. That all addresses be posted in accordance with Ordinance #20; and, 11. That a Building Permit be obtained for any structure exceeding 144 square feet or located on a permanent foundation which requires a site plan to be reviewed and approved by the Planning Director. Vote: Unanimous. D. LAYOUT PLAT / PL: Tim Gregson; Jim Peterson – Agent. To create two lots in accordance with Section 400.1 of the Pennington County Subdivision Regulations. EXISTING LEGAL: Lot 1 of Tract 0017 and Block 1 less Lot H-1 (also in Section 12), Block 1, Town of Deadbroke, all in Section 1, T2S, R4E, BHM, Pennington County, South Dakota. PROPOSED LEGAL: Lots 1 and 2 of Block 1 of Town of Deadbroke, Section 1, T2S, R4E, BHM, Pennington County, South Dakota. MOVED by Holbrook and seconded by Trautman to accept the recommendation of the Planning Commission to approve PL 08-46 with the following nine conditions: 1. That prior to County Board approval of the Final Plat, engineered road construction plans be submitted for the 40 foot access easement or a Subdivision Regulations Variance be obtained waiving this requirement; 2. That prior to County board approval of the Final Plat, the 40 foot access easement be improved to a minimum of Local Road Standards, which includes a minimum driving surface of 20 feet and minimum of 4 inches of gravel or a Subdivision Regulations Variance be obtained waiving this requirement; 3. That prior to Minor Plat submittal, the applicant submits percolation tests and soil profile information to be reviewed and approved by the Environmental Planner or obtain approval of a Subdivision Regulations Variance waiving this requirement; 4. That prior to County Board approval of the Final Plat, the plat heading be corrected to “Dead Broke” from “Deadbroke”; 5. That prior to County Board approval of the Final Plat, the mobile home be removed and the drainfield abandoned or a Conditional Use Permit approved for a caretaker’s residence; 6. That only one access be allowed from South Dakota Highway 385; 7. That at the time of submittal of the Minor Plat, the applicant submit topography at 2 foot contour intervals or approval of a Subdivision Regulations Variance be obtained waiving this requirement; 8. That at time of submittal of the Minor Plat, the applicant must submit information in regards to water supply; and, 9. FIRST READING AND PUBLIC HEARING OF PLANNED UNIT DEVELOPMENT / PU 08-13: Walter and Ruth Ann Jensen. To rezone 20 acres from Limited Agriculture District to a Planned Unit Development to allow for a Resort Development to include uses, such as weddings, receptions, and a bed and breakfast in accordance with Section 213 of the Pennington County Zoning Ordinance. Lot 1, Columbus South Subdivision, Section 17, T2N, R6E, BHM, Pennington County, South Dakota. MOVED by Trautman and seconded by Holbrook to approve the first reading of PU 08-13 with the following twenty-nine conditions: 1. That the purpose of this Planned Unit Development be to allow a Specialty Resort for a Bed and Breakfast and events, such as: weddings, receptions, company picnics, family reunions, church functions, bridal and baby showers, Christmas parties and other types of small gatherings similar in nature; 2. That the number of guests be limited to 100 people; 3. That this Planned Unit Development be considered an overlay zoning district whereby the provisions of the underlying Limited Agriculture District still apply and if the property is no longer utilized as a Specialty Resort, the zoning revert back to Limited Agriculture District assuming the same lot configuration; 4. That the PUD be revoked if the property is transferred to new owners; 5. That prior to operation of the Specialty Resort, the applicant create an Emergency Plan to evacuate guests from the property in the event of an emergency and that a copy of said plan be submitted to the Planning Department to be kept on file; 6. That a minimum of 50 parking spaces be provided on-site, each measuring a minimum of 9 feet by 18 feet and maintained in a dust-free manner; 7. That prior to operation of the Specialty Resort, the applicant submit a Parking Plan to the Planning Office for review to ensure its compliance with the Minimum Off-Street Parking requirements as outlined in Section 310 of the Pennington County Zoning Ordinance; 8. That the internal driveway be widened to 24 feet in width consisting of a gravel surface to accommodate two-way traffic prior to operation of the Specialty Resort; 9. That all music being provided for outdoor activities be shut down by 10:00 p.m.; 10. That the applicant posts a stop sign at the intersection of the driveway and Nemo Road during events; 11. That temporary structures, such as tents and port-o-potties only be erected when needed and not on a permanent basis; 12. That all exterior lighting must be of low level intensity, which does not result in excessive glare upon surrounding neighbors; 13. That the applicant have the existing approach off of Nemo Road reviewed by the Pennington County Highway Department for the change in use and that a copy of the amended Approach Permit be provided to the Pennington County Planning Office prior to operation of the Specialty Resort; 14. That the applicant obtain all necessary permits from other governing bodies for operation of the Specialty Resort including, but not limited to, approval from the South Dakota Department of Health and a Sales Tax License from the South Dakota Department of Revenue; 15. That a smoke detector be placed in each sleeping room utilized for the Bed and Breakfast with a minimum of at least one (1) smoke detector per floor; 16. That a portable fire extinguisher with a minimum 2 A-BC rating shall be placed on each floor level of the Bed and Breakfast so it accessible to all guests at all times and the fire extinguisher shall be inspected and tagged annually; 17. That the maximum number of people staying at the Bed and Breakfast establishment at one time be in compliance with the South Dakota Lodging Establishments Health and Safety Manual; 18. That the applicants comply with South Dakota Codified Law 34- 18-9.4, which regulates Bed and Breakfast establishments and requires a guest list to be maintained; 19. That the physical address for the residence be posted in each guest room utilized for the Bed and Breakfast; 20. That prior to installation of any on-site wastewater system or alteration to the existing on-site wastewater system, an approved On-Site Wastewater Construction Permit be obtained through the Pennington County Planning and Zoning office; 21. That the applicants obtain approval from the South Dakota Department of Environment and Natural Resources for the existing means of wastewater disposal servicing the residence prior to operation of the Bed and Breakfast; 22. That port-o-potties may be utilized by the guests of the events for wastewater disposal, but any other means of wastewater disposal will require proper permitting and review of the system by both the Pennington County Planning Department and South Dakota Department of Environment and Natural Resources; 23. That prior to the placement of any on-premise signs, the applicant must obtain approval of a Sign Permit; 24. That the lot address be clearly posted on both the residence at the approach to the property so it is visible from both directions along Nemo Road in accordance with Pennington County’s Ordinance #20; 25. That the applicant ensures the residential character of the property is maintained; 26. That a Building Permit be obtained for any structure exceeding 144 square feet or located on a permanent foundation, which includes the necessary site plans to be reviewed and approved by the Planning Director; 27. That the Planning Director may allow additional development or construction, which is consistent with the existing development on this property. Significant changes in the use or impacts on adjacent land, uses as determined by the Planning Director, shall require an amendment to this Planned Unit Development; 28. That the applicant signs a Statement of Understanding, which is available at the Planning Office, prior to operation of the Specialty Resort; and, 29. MINOR PLAT / PL 08-47 AND SUBDIVISION REGULATIONS VARIANCE / SV 08-15: Dale and Dolores Schrier; Hanson Surveying – Agent. To reconfigure existing lot lines to create Martha Washington Place and to waive for the scale of the plat to be at 1 inch = 100 feet, topography at 2 foot contour intervals, percolation tests and soil profile information, and to waive improving the Section Line to Ordinance 14 Standards in accordance with Section 400.3 of the Pennington County Subdivision Regulations. EXISTING LEGAL: SW1/4NW1/4; PT GL 4 (Lot A of NW1/4NW1/4) Section 2 and PT GL 1; GL 2 less Lots A and B and SE1/4 NE1/4, Section 3 all located in T2S, R5E, BHM, Pennington County, South Dakota. The density of the Planned Unit Development shall not exceed 148 residential lots; 2. That the common areas include a golf driving range, mini golf course, hiking-biking trails, frisbee course, picnic area, picnic shelter, recreation pond/lake, archery area, exercise/community building, pool/water park, kid play equipment, softball field, football field, basketball court, tennis court, volleyball court, skate park, garden plots, hobby plane/paraplane flying area, horseshoe pits and paintball area; 3. That a horse boarding/arena/barn be allowed on Common Lot 1, Block 1 and that the horse area be for the residents of the Sunset Ranch and their guests; 4. The applicant submits an engineered individual wastewater disposal system to be approved by the Pennington County Environmental Planner; 11. That the entire portion of 156th Avenue to 229th Street be paved and improved in accordance with the approved Construction Plans prior to issuance of the fifty-first (51st) Building Permit or Surety be posted that will expire within six (6) months after the issuance of the fifty-first (51st) Building Permit; 12. That the applicant obtains an approved Floodplain Development Permit for any construction work within the 100-year floodplain; 13. That prior to platting, the applicant provides documentation from Dakota, Minnesota & Eastern Railroad allowing the two (2) primary routes through the railroad right-of-way; 14. That prior to any plat approval, the applicant provide lighted warning devices at the two (2) primary route crossings through DM&E railroad right-of-way; 15. That 229th Street is maintained according to Ordinance 14 Standards; 16. That prior to County Board approval of the Planned Unit Development, the applicant shall submit a Fire Protection Plan for review and approval by the Pennington County Fire Coordinator. The Pennington County Fire Coordinator will determine the number of fire hydrants and exact locations; 17. The minimum setbacks for the Planned Unit Development shall be twenty-five (25) feet from all property lines and fifty-eight (58) feet from all Section Lines; 18. That a Homeowner’s Association be created for the maintenance of the road, community water system, and all use within the common areas; 19. That one wind generator be allowed on each lot and the wind generator not exceed a height of 55 feet; 20. That the applicant signs a Noxious Weed Plan to control noxious weeds located on the property; 21. That this Planned Unit Development be reviewed upon a complaint basis only; and, 22. That this Planned Unit Development Amendment is not valid until the applicant signs the Statement of Understanding, which is available at the Planning Office. Vote: Unanimous. J. GENERAL FUND SURPLUS ANALYSIS The amount of General Fund dollars that counties can retain as surplus is restricted by SDCL 7- 21-18.1 which states: “The total unreserved, undesignated fund balance of the General Fund may not exceed forty percent of the total amount of all General Fund appropriations contained in the budget for the next fiscal year.
