PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES July 15, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, July 15 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Ethan Schmidt and Nancy Trautman. REVIEW AND APPROVE AGENDA MOVED by Kjerstad and seconded by Holbrook to approve the agenda with the following addition: BH Speedway Fireworks Permit. Vote: Unanimous. REVIEW MINUTES MOVED by Trautman and seconded by Kjerstad to approve the minutes of the July 1, 2008, Board of Commissioners' meeting as presented. Vote: Unanimous. ITEMS FROM THE AUDITOR A. BUDGET SUPPLEMENT HEARING (SP08-11): MOVED by Schmidt and seconded by Trautman to supplement the 2008 Accumulated Building Courthouse Preservation Budget in the amount of $17,590 from designated cash reserves ($10,590) and current year grant revenues ($7,000). Vote: Unanimous. BUDGET SUPPLEMENT HEARING (SP08-10): MOVED by Trautman and seconded by Schmidt to supplement the 2008 County Fire Fund Operating Budget from cash reserves in the amount of $50,000. Vote: Unanimous. B. E. 2009 PROVISIONAL BUDGET APPROVAL: MOVED by Schmidt and seconded by Trautman to authorize the chair’s signature to a letter to our congressional delegation to support any effort to re-authorize the Secure Rural Schools and Community Self-Determination Act of 2000 with language coming from Hiene Junge, Highway Superintendent. Vote: Unanimous. MOVED by Kjerstad and seconded by Trautman to approve the Pennington County 2009 Provisional Budget at $65,159,000, with means of finance by $31,897,136 in current property taxes, $32,044,921 in miscellaneous revenues, and $3,818,961 in cash reserves, and to set a public hearing for September 2, 2008 at 10:00 a.m. Vote: Unanimous. BH SPEEDWAY FIREWORKS PERMIT (Con’t from 7/1/08): MOVED by Schmidt and seconded by Trautman to deny the request for a Fireworks Permit for July 4, 2008, for BH Speedway. BID AWARD-BRIDGE REPAIR 52-460-329: MOVED by Schmidt and seconded by Kjerstad to award the 2008 Bridge Repair for Bridge 52-460-329 to J.V. Bailey Company, Inc, 101 St. Joseph St, Rapid City, South Dakota, the low bidder, in the amount of $18,750.00. Vote: Unanimous. ADOPT-A-HIGHWAY PROGRAM; CLEGHORN CANYON ROAD: MOVED by Holbrook and seconded by Schmidt to authorize Western Health to volunteer to take responsibility for cleaning approximately one mile of Cleghorn Canyon Road starting at Jackson Boulevard and ending one mile west. Vote: Unanimous. LIEN RELEASE REQUEST (JTH): MOVED by Holbrook and seconded by Schmidt that due to special circumstances (name withheld per SDCL 28-13-42) be allowed to pay $10.00 per month to Credit Collections for payment on the lien. Holbrook left the meeting at 10:10 a.m. MEADE COUNTY REQUEST FOR RESOLUTIONS A. RESOLUTION – PLUM ISLAND ANIMAL RESEARCH FACILITY: MOVED by Schmidt and seconded by Trautman to approve the following resolution regarding Plum Island Animal Research Facility with the addition of one sentence: That efforts be pursued to reinstate the federal law prohibiting foot and mouth disease on the mainland of our county that was nullified and deleted from the recent Farm Bill. Vote: Unanimous. Pennington County Resolution against moving the Plum Island Animal Research Facility Whereas, foot and mouth disease is deadly to cattle, sheep, goats, deer, elk, antelope, and bison, and Whereas, foot and mouth virus can be carried on a worker’s breath or clothes, or vehicles leaving a lab, and is so contagious it has been confined to Plum Island, New York, for over 50 years—far from commercial livestock. The existing lab is 100 miles northeast of New York City, accessible only by ferry or helicopter. Researchers there who work with live viruses are not permitted to own animals, and they must wait at least a week before attending events where animals might perform, and Whereas, an epidemic in 2001 devastated Britain’s livestock industry when the government slaughtered 6 million sheep, cows, and pigs. In 2006, Britain’s health and safety agency concluded that another outbreak of the virus probably escaped from a site shared by a government research center and a vaccine maker, and Whereas, in Surrey, England, in 2007, there was a release of foot and mouth disease from a lab which was discovered only after cattle were found to be infected. The outbreak was traced to cracked sewer lines, which leaked material, creating mud, which was carried off the site by automobiles, and Whereas, wildlife is a part of the custom and culture of all states and the numbers greatly surpass the wildlife population in England, and Whereas, cleanup of a foot and mouth outbreak includes preemptive slaughter of all susceptible animals, and animals and insects which carry the virus. Buildings which cannot be adequately decontaminated must be burned, and travel in the contaminated area must be controlled, and Whereas, A 2002 Purdue University study estimated an outbreak of Foot-and- Mouth disease would cost the US livestock industry 10 to 33 billion dollars. The cost in worldwide food shortages and increased food prices is immeasurable, and Whereas, animals can be vaccinated against foot and mouth but this action would remove the United States from the ‘Foot and Mouth Free’ list and prohibit beef export, and Whereas, Control of the Research facility was transferred from the Department of Agriculture to the Department of Homeland Security in 2003. The DHS wants to move the facility to a site in Georgia, Texas, Kansas, North Carolina, or Mississippi. The new lab will also study diseases that can be transferred from animals to humans, and Whereas, if one of these diseases is released, the consequences for the community may be very grave. These diseases can be transmitted, variously, by air, mosquitoes, ticks, and other parasitic insects, and by contact with a person or surface material bearing the disease. Incubation periods vary considerably, which means that by the time an outbreak is discovered, the disease may have spread considerably. Because there are no treatments for these diseases, infected animals must be quarantined and destroyed. As to those diseases to be studied at the site which can also affect humans, it remains to be seen how Homeland Security will choose to deal with infected humans, or those suspected of carrying the infection, and Whereas, the lab at Plum Island has had at least one accidental pathogen release within the facility, and Whereas, The Department of Homeland Security is currently investing money to improve and upgrade the Plum Island facility, and Whereas, Plum Island is on the list of possible sites for the new National Bio-and Agro-Defense Facility which is planned to replace the existing facility, and Whereas, over half of the 50 largest pharmaceutical companies, including Bayer, GlaxonSmithKline, Novartis, Hoffman-LaRoche, Astra Zeneca, and Merck, are foreign companies. Therefore be it resolved that efforts be pursued to reinstate the federal law prohibiting foot and mouth disease on the mainland of our county that was nullified and deleted from the recent Farm Bill. Therefore be it resolved that the facility remain on Plum Island New York, where it can be isolated from both domestic and wild animals. Be it further resolved that if the present facility at Plum Island must be closed, we rely on the expertise at all the existing laboratories in other countries to develop treatments or vaccines for these diseases. RESOLUTION – WOLF POLICY: MOVED by Trautman and seconded by Kjerstad to approve the following resolution regarding a wolf policy in Pennington County. Vote: Unanimous. RESOLUTION ON WOLF POLICY IN PENNINGTON COUNTY WHEREAS, wolves are schedule to be removed from the Federal Endangered Species List on February 28, 2008, and WHEREAS, Mike Kintigh of the South Dakota Game Fish and Parks Department says wolves will be migrating into South Dakota from Minnesota and Wyoming, and that wolves pose a much greater threat to livestock than mountain lions do (KEVN News, January 13, 2008), and WHEREAS, South Dakota Codified Law 40-36-3 requires the Department of Agriculture to cooperate with counties, associations, corporations, or individuals if such cooperation is necessary to control injurious animals pursuant to SDCL 40-36-1, and WHEREAS, since the late 1980’s, over 1400 wolves are estimated to have been killed in the Northern Rockies but the population has sill increased about 24% a year, (Associated Press, Rapid City Journal, February 22, 2008) and WHEREAS, the Contingency Plan for Responding to Gray Wolf Depredations of Livestock in South Dakota says South Dakota has no suitable habitat for wolves and that South Dakota is not critical for the recovery of the species. Their basic criteria are: 1. Presence of adequate prey. 2. Minimum contiguous area of 3,000 square miles with less than 10% private land. 3. Absence of grazing livestock. 4. Sufficient isolation to support 10 breeding pairs, Also that South Dakota has no suitable area to relocate a problem wolf and that neighboring states are unlikely to take a depredating wolf, and WHEREAS, Eastern Wyoming classifies wolves as predators and wolves in Minnesota are not listed as endangered, THEREFORE, BE IT RESOLVED, that wolves be classified as an injurious predatory animal with the coyote, and that they are to be removed by anyone, without regard to license or reason, if they threaten livestock, pets or humans in any way. THEREFORE, BE IT FURTHER RESOLVED, that the South Dakota Department of Game, Fish and Parks, and the South Dakota Department of Agriculture make it their policy to list wolves as an injurious animal, with the coyote. THEREFORE, BE IT FURTHER RESOLVED, that wolves not be listed as a game animal in South Dakota. Moved, passed and adopted this 15th day of July, 2008. To reduce the minimum required 25 foot front yard setback to 5 feet to allow for a deck in a Highway Service District in accordance with Sections 210 and 509 of the Pennington County Zoning Ordinance. Lot 17, The Forks at Remmington Ranch, Section 22, T1S, R5E, BHM, Pennington County, South Dakota. MOVED by Schmidt and seconded by Trautman to approve VA 08-13 with the following conditions: 1. That prior to County Board approval, the portion of the utility and minor drainage easement be vacated that is being encroached upon; 2. That all structures and utilities, including the on-site wastewater system, maintain proper setbacks to the proposed lot lines or else approved Variances be obtained; 3. That the address be posted on the store in accordance with Ordinance #20; and, 4. That a Building Permit be obtained for any new structures exceeding 144 square feet and located on a permanent foundation, which will require a site plan to be reviewed and approved by the Pennington County Planning Director.
