PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES May 20, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, May 20, 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 8:15 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Ethan Schmidt, and Nancy Trautman. REVIEW AND APPROVE AGENDA MOVED by Schmidt and seconded by Kjerstad to approve the agenda with the following additions: Contractual and litigation under last Executive Session; Discussion of US Forest Service news release regarding prairie dogs under Items from Highway; Ellsworth Task Force under Items From Public. Vote: Unanimous. REVIEW MINUTES MOVED by Trautman and seconded by Schmidt to approve the minutes of the May 6, 2008, Board of Commissioners' meeting. Vote: Unanimous. VALLEY HEIGHTS ESTATES ROAD DISTRICT: MOVED by Holbrook and seconded by Trautman to order that an election for the determination of the organization of the Valley Heights Estates Road District be held on June 10, 2008, and further move that if the question for organization should pass, those present and eligible shall hold an immediate election of the first Board of Trustees for the newly organized road district. DISCHARGE LIENS OF DECEASED INDIVIDUALS: MOVED by Schmidt and seconded by Trautman to authorize the Chairperson’s signature on the Resolution to Discharge County Aid Liens of Deceased Persons. RESOLUTION TO DISCHARGE COUNTY AID LIENS OF DECEASED PERSONS WHEREAS, the Pennington County Commission has determined that it is in the County’s best interest to discharge county aid liens against deceased persons and those liens deemed uncollectible; and WHEREAS, Credit Collections Bureau has researched and reported the following thirty-three (33) such liens totaling $180,028.25, as listed on the ORDER TO RELEASE INDIGENT LIEN on file in the Pennington County Auditor’s office; now THERFORE BE IT RESOLVED, BY THE Pennington County Board of Commissioners, that the Register of Deeds is hereby directed to discharge these liens. MOVED by Holbrook and seconded by Trautman to accept the Planning Commission’s recommendation to approve Layout Plat 08-18 with the following twelve conditions: 1. That the all proper setbacks be maintained as a result of the proposed subdivision, including 25 feet from all property lines for structures and 10 feet for septic systems, or else an approved Setback Variance be obtained for any existing or future structures; 2. That the applicant submit a site plan showing the location of all existing septic systems located on the subject properties, including setback distances to lot lines for review by the Pennington County Environmental Planner to ensure setbacks to the proposed lot lines will be met by the proposed subdivision; 3. That at the time of submittal for the Preliminary Plat, the plat meets all the requirements of Section 400.2 of the Pennington County Subdivision Regulations, including the Preliminary Plat to be scaled at not more than one inch equals one hundred feet, and topographic information be provided of the subject property at two foot contour intervals or the applicant obtains an approved Subdivision Regulations Variance waiving any of these requirements that are not met; 4. That the applicant dedicate an access easement to the proposed unplatted Balance of Government Lot 5, which must be recorded at the Register of Deeds, prior to approval of the Final Plat; 5. That proposed Lot 2 of Rushmore Cave Subdivision be Rezoned to Low Density Residential District or the applicant obtain an approved Lot Size Variance prior to filing of the Final Plat at the Register of Deeds; 6. That the existing cave operation be able to continue as it has been run in the past within the boundaries of existing Government Lot 5, though future expansion or further development will require the property to be brought into compliance with a Conditional Use Permit allowing for a Recreational Resort; 7. That the heading on the Plat document be changed to reflect both the Register of Deeds’ and Department of Equalization’s comments; 8. That no Building Permits be issued for or further development occur on the proposed unplatted Balance of Government Lot 5 until the property is brought into compliance with the Pennington County Zoning Ordinance; 9. That the lot size of proposed Lot 1 of Rushmore Cave Subdivision remain equal to or greater than 40 acres to comply with the minimum lot size requirement for a General Agriculture Zoning District or else the property be Rezoned or an approved Lot Size Variance be obtained to allow for a smaller lot size; 10. That the applicant obtain an additional ten (10) feet of access easement for a total of a 40-foot-wide access easement to provide access to the subject properties from Highway 40 or else obtain an approved Subdivision Regulations Variance waiving this requirement; 11. That the applicant provide engineered road plans for both the access easement crossing private properties from Highway 40 to proposed Lot 1 of Rushmore Cave Subdivision and the access easement across proposed Lot 1 of Rushmore Cave Subdivision providing legal access to proposed Lot 2 of Rushmore Cave Subdivision at the time of Preliminary Plat submittal or else obtain an approved Subdivision Regulations Variance waiving this requirement; and, 12. That prior to County Board approval of the Final Plat, the well house be relocated to meet the setback requirements of the Planned Unit Development; 3. That prior to submittal of the Preliminary Plat, the reference to Lot 1 of Three Forks Subdivision be revised and shown as Lot 17 of The Forks at Remington Ranch; 4. The community drainfield must be designed by a Registered Professional Engineer and the applicant must receive proper permitting and approval from the County and the State for the community drainfields prior to applying for a Final Plat; 7. That approved On-Site Wastewater Construction Permits be obtained prior to any wastewater system being installed or the issuance of any Building Permits on any of the proposed lots; 8. MOVED by Schmidt and seconded by Trautman to deny RZ 08-01 without prejudice pursuant to Planning Commission recommendation. Vote: Unanimous. G. PRELIMINARY PLAT / PL 08-13 AND SUBDIVISION REGULATIONS VARIANCE / SV 08-05: Ryan McFarland; Hanson Surveying – Agent. To create Lots 1-5 of Hisega High Meadows Subdivision in accordance with Section 400.2 and to waive a second means of ingress/egress, for the scale of the plat to be 1 inch = 100 feet, and for the topography to be at 2 foot contour intervals of the Pennington County Subdivision Regulations. That prior to County Board approval of the Final Plat, the applicant constructs the secondary means of ingress/egress, submit surety for the improvements or obtain an approved Subdivision Regulations Variance waiving this requirement; 2. That prior to County Board approval of the Final Plat, the applicant submit road construction plans for the construction of a secondary means of ingress/egress, or the applicant obtains an approved Subdivision Regulations Variance waiving this requirement; 3. That prior to occupancy of the single-family residence, the applicant must provide a letter from the State’s Fire Marshall; 2. That the applicant continues to have and maintain all necessary permits from the South Dakota Department of Social Services; 3. That the applicant maintains a copy of the license from the Department of Health prior to occupancy of the single-family residence; 4. That no more than seven veterans reside on premise; 5. That this Conditional Use Permit be reviewed in one year or on a complaint basis; and, 6. Kjerstad left the meeting at 11:30 a.m. MOVED by Holbrook and seconded by Schmidt to deny CU 08-16 without prejudice because of aesthetics and location. Holbrook called the question.
