PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES April 15, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, April 15, 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Brenda Young called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Jim Kjerstad, Ethan Schmidt and Nancy Trautman. COST OF COMMUNITY SERVICES - Marvin Bishop MOVED by Trautman and seconded by Kjerstad to adopt the Resolution to Set Maximum Allowable Surcharge for Indirect Costs Included in Contracts With the County and authorize the Chairperson’s signature thereon. PENNINGTON COUNTY RESOLUTION TO SET MAXIMUM ALLOWABLE SURCHARGE FOR INDIRECT COSTS INCLUDED IN CONTRACTS WITH THE COUNTY WHEREAS, Pennington County is organized to represent and provide services to the residents of the County, and WHEREAS, Pennington County has limited sources for generating revenue, primarily property taxes and service fees, and WHEREAS, Pennington County has severe challenges balancing the budget with increased request for services such as law enforcement, road maintenance, and information requests, and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pennington County Board of Commissioners that Pennington County hereby sets 25% as the maximum allowable surcharge for indirect costs in addition to the actual costs of services for which it contracts. A RESOLUTION FOR THE PROTECTION OF WATER RESOURCES IN PENNINGTON COUNTY WHEREAS Pennington County recognizes and appreciates the efforts of Mayor Alan Hanks and Louie Arguello to alert and inform the public about the need to protect the drinking water resources of Pennington County and the need for a county-wide program to achieve this goal; and WHEREAS, the Pennington County Commission recognizes that the health, safety and general welfare of all citizens of Pennington County depends upon a clean and reliable source of drinking water; and WHEREAS, the Pennington County Commission recognizes that the implementation of a county-wide ordinance will help ensure a sustainable source of drinking water and also help to avoid unnecessary costs in the future for failure to take action today; and WHEREAS, in furtherance of this goal, the Board of County Commissioners for Pennington County desire to adopt a drinking water protection ordinance to be implemented and enforced by Pennington County in all areas outside the jurisdiction of a municipality; and WHEREAS, the Pennington County Commission will seek the cooperation of the City of Rapid City and other municipalities within the County to achieve the goals stated herein; and NOW THEREFORE, BE IT HEREBY RESOLVED by the County of Pennington that a water protection program be created by ordinance to preserve and protect drinking water resources within the jurisdiction of Pennington County. To reduce the minimum required 25 foot front yard setback to 15 feet in a Suburban Residential District in accordance with Sections 208 and 509 of the Pennington County Zoning Ordinance. MOVED by Schmidt and seconded by Holbrook to approve Variance 08-07 to reduce the front yard setback along Sedivy Lane from 25 feet to 15 feet to allow for the construction of a single- family residence with the following five (5) conditions, pursuant to staff recommendation. Vote: Unanimous. 1. That direct access to the property be taken from E. Saint Francis Street, no access shall be granted from Sedivy Lane; 2. That the irrigation lateral located on the property not be disturbed and/or filled in with dirt during the construction of the single-family residence; 3. That the single-family residence be constructed to preclude from interfering with the line of sight at the intersection of Sedivy Lane and E. Saint Francis Street, 4. That this Variance only applies for the portion of the setback requirement that will be encroached upon by construction of the single-family residence along Sedivy Lane. PUD 08-04 AN ORDINANCE AMENDING SECTION 508 OF THE PENNINGTON COUNTY ZONING ORDINANCE, REZONING THE WITHIN DESCRIBED PROPERTY: BE IT HEREBY ORDAINED BY THE PENNINGTON COUNTY COMMISSION THAT THE PENNINGTON COUNTY ZONING ORDINANCE BE AND HEREBY IS AMENDED BY AMENDING THE ZONING OF THE FOLLOWING DESCRIBED PROPERTY: The N1/2 of the NE1/4 lying east of County Road, Section 18, T1N, R3E, BHM, Pennington County, South Dakota.
