PENNINGTON COUNTY BOARD OF COMMISSIONERS MINUTES January 8, 2008 A meeting of the Pennington County Board of Commissioners was held on Tuesday, January 8, 2008, in the Commissioners' meeting room of the Pennington County Courthouse. Chairperson Jim Kjerstad called the meeting to order at 9:00 a.m. with the following Commissioners present: Gale Holbrook, Ethan Schmidt, Nancy Trautman and Brenda Young. ELECTION OF OFFICERS BY AUDITOR The floor was opened by Auditor Julie Pearson for nominations for Chairperson. MOVED by Trautman to nominate Brenda Young for Chairperson. DESIGNATE LEGAL NEWSPAPERS (3) MOVED by Schmidt and seconded by Trautman to designate the Rapid City Journal, the Pennington County Courant and the Southern Hills Publishing, Inc. as the three legal newspapers for Pennington County for 2008. Vote: Unanimous. RESOLUTION – DRUG FREE WORKPLACE CERTIFICATION MOVED by Schmidt and seconded by Trautman to approve the resolution for Drug Free Workplace Act Certification for A Public Entity. Vote: Unanimous. DRUG-FREE WORKPLACE ACT CERTIFICATION FOR A PUBLIC ENTITY 1. The County of Pennington Certifies that it will provide a drug-free workplace by: a. Publishing a statement notifying employees that unlawfully manufacturing, distributing, dispensing, possessing or using a controlled substance in the recipient’s workplace is prohibited and specifying the actions that will be taken against employees for violation or such prohibition. b. Establishing a drug-free awareness program to inform employees about: 1. The dangers of drug abuse in the workplace; 2. The recipient’s policy of maintaining a drug-free workplace; 3. Any drug counseling, rehabilitation and employee assistance programs that are available; and 4. The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace. c. Making it a requirement that each employee to be engaged in the performance of the grant or cooperative agreement be given a copy of the statement required by paragraph (a). d. Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under the grant or cooperative agreement, the employee will; 1. Abide by the terms of the statement; and, 2. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such a conviction. e. Notifying the federal sponsoring agency within ten days after receiving notice under subparagraph (d) (2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other appropriate agency. f. Taking one of the following actions, within 30 days of receiving notice under subparagraph (d)(2), with respect to any employee so convicted; 1. Taking appropriate personnel action against such an employee, up to and including termination; or 2. Requiring such an employee to satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement, or other agency. g. Making a good faith effort to continue to maintain a drug-free workplace through implementation of paragraphs (a), (b), (c), (d), (e), and (f). 2. PENNINGTON COUNTY COMMISSION RESOLUTION TO SUPPORT PRESERVATION OF THE MEEKER RANCH BUILDINGS WHEREAS, the Meeker Ranch is located approximately four miles northeast of Custer, South Dakota, in a beautiful valley on National Forest Service land bordering the Norbeck Wildlife Preserve; and WHEREAS, situated upon the Meeker Ranch property are a number of historic structures including, the original homestead cabin, livestock barn and other assorted out buildings and structures; and WHEREAS, the Meeker Ranch and the buildings located there are representative of the rich history and beauty of our Black Hills and afford a unique opportunity to film, paint, and otherwise enjoy their existence for generations to come; and WHEREAS, out of concern for the present condition of some of the structures, the expense to restore, maintain, and otherwise preserve the buildings, and the potential of liability associated therewith, Black Hills National Forest officials are considering plans to destroy all of the buildings except for the original homestead cabin; and WHEREAS, with the assistance of artist Jon Crane and others, an alternative plan to raise awareness of this historic treasure and raise money to assist in the potential restoration, maintenance and preservation of the Meeker Ranch buildings is under way and will be presented to the Forest Service. Craig Bobzien, Supervisor for the Black Hills National Forest, has agreed to suspend immediate plans to destroy the ranch buildings in order to hear public input as to other available options; and NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Pennington County Board of Commissioners that Pennington County supports any plan or effort designed to restore, maintain, and preserve the historic and natural beauty of the Meeker Ranch and the buildings situated thereon and further encourages other counties particularly in the Black Hills region to express their support as well. To reduce the minimum required 25 foot rear yard setback to 6 feet in a Suburban Residential District to allow for the construction of a single- family residence in accordance with Sections 208 and 509 of the Pennington County Zoning Ordinance. MOVED by Holbrook and seconded by Kjerstad to accept staff recommendation to approve VA 08-01 to reduce the minimum required rear yard setback from 25 feet to eight (8) feet with the following six (6) conditions: 1. That a Building Permit be obtained for any structure exceeding 144 square feet or located on a permanent foundation, which requires a site plan to be reviewed and approved by the Planning Director; 2. That this Variance only applies for the portion of the setback requirement that will be encroached upon by construction of the proposed residence. All other structures must maintain the proper setback requirements or obtain separate Variance(s) for that structure; 3. That the address be properly posted on both the residence and at the approach so it be visible in both directions in accordance with Pennington County’s Ordinance #20; 4.
